# Casino Time Privacy and Cookies Policy **v1.4 - August 19, 2024** This Casino Time Privacy and Cookie Policy (hereafter, the “Policy”) is incorporated into and forms Section 3 part (iv) of the Casino Time Terms & Conditions(the “Player Agreement”). Any conflict or inconsistency between this Policy and the terms of the Player Agreement shall be resolved in accordance with Section 3 of the Player Agreement. ## 1. What Does This Policy Govern? This Policy governs the collection, use, disclosure, retention, and other processing of personal information by Casino Time, including through Casino Time products and services, on Casino Time websites (“Websites”) and via mobile applications (collectively, the offerings via the Website, the mobile applications and Casino Time’s other products and services, shall be referred to in this Policy as the “Services”). This Policy explains what types of personal information are collected, how the personal information may be used (for what purposes), to whom the personal information may be transferred or disclosed, and how you can ask us questions about our privacy practices. Generally speaking, “personal information” means information about an identifiable individual. If you do not want us to collect, use, or share your information in the ways described in this Policy, please do not use the Services. By using the Services, you consent to the collection and use of your information (including personally identifiable information) by us as identified herein, in compliance with this Policy and the terms and conditions for the Services. ## 2. Context for Casino Time’s Personal Information Practices Casino Time is running Casino Time Website and providing Casino Time Offerings as part of the open and regulated internet gaming (iGaming) market in Ontario conducted and managed by iGO In the course of providing the Services, in relation to player account, Casino Time collects, uses and discloses personal information on behalf of and as agent to iGaming Ontario. Casino Time collects personal information in accordance with The Freedom of Information and Protection of Privacy Act (Ontario) (FIPPA), Personal Information Protection and Electronic Documents Act (“Acts”) and other applicable privacy laws, and under the authority of Ontario Regulation 722/21 made under the Alcohol and Gaming Commission, and the operating agreement entered into between Casino Time and iGaming Ontario, as each of the foregoing is amended and/or replaced from time to time. ## 3. Definitions If not otherwise defined in this Policy, the following terms when used in this Policy shall have the meanings set out beside them. **Cookies** – A packet of data sent by a web server to a browser, which is returned by the browser each time it subsequently accesses the same server, used to identify the user, or track their access to the server. **Device** – piece of portable electronic equipment that can connect to the internet, such as a smartphone, tablet, or laptop computer. FIPPA – Freedom of Information and Protection of Privacy Act provides a right of access to records held by public bodies and regulates how public manage personal information. **HIO** – Person who currently holds or has held within the last 5 years the specific office or position of head of an international organization. **iGO** – Internet Gaming of Ontario, working with the Government of Ontario and the Alcohol and Gaming Commission of Ontario (AGCO) to establish a new online gaming market that helps protect consumers gambling through private companies (Operators). **PCMLTFA** – Proceeds of Crime (Money Laundering) and Terrorist Financing Act implements specific measures to detect and deter money laundering and financing of terrorist activities to facilitate the investigation or prosecution of money laundering and terrorist financing offences. **Player Account** – Player’s account of notional funds corresponding to Canadian dollars that is maintained on the iGaming Platform, and also includes the Player’s registration information, deposit and withdrawal transaction history, and game-play information that the Player can access through CasinoTime.ca. **PEP** – Politically Exposed Person is an individual who has a high-ranking job in government or some other type of political position. Payment Service Provider – financial entity that is authorized to process transactions between Player and Casino Time. **Processing** – the collection, use, disclosure, transfers, storage, and other processing of personal information. **SMS** – text messaging service component of most telephone, internet, and mobile devices. **Third Party** – An individual or entity that is involved in a transaction but is not one of the principles and, thus, has a lesser interest in the transaction. ## 4. What Personal Information is Collected? Casino Time collects the types of personal information, which is required by law, or otherwise reasonably necessary to achieve the purposes set out in this Policy. “Under FIPPA, “personal information” means recorded information about an identifiable individual.” The following provides some examples of personal information Casino Time may collect:
(a) Identity information (such as full name, Driver’s Licence number or other official ID number, etc.)
(b) Demographic information (such as your age)
(c) Contact information (such as your email address and phone number)
(d) Location information (such as your address and the location of a device you use to access your website or applications)
(e) Professional information (such as your occupation and industry of employment)
(f) Banking or financial information (such as payment or withdrawal account information) and
(g) Transaction information (such as play or payment history, customer service history, or other information related to transactions between you and Casino Time.)
You can visit Casino Time’s websites without registering for an Internet Gaming account (“Internet Gaming”). However, certain products and services available through Casino Time websites require that you register for an Internet Gaming account. Should you choose to register for an Internet Gaming account, Casino Time will process your personal information in the course of administering your account. The following types of information may be collected throughout your registration for, and use of, an Internet Gaming account: * Full Name * Home Address * Date of Birth * Email Address * Phone Number * Transaction and Play History * Supporting Documents to verify Identity (government issued identification including Driver’s Licence, Passport etc.) * Device Information and Connection IP Address * Payment Information * Withdrawal Account Information * Language and Marketing Preferences * Device Location * Supporting Documents to Confirm Withdrawal Account ownership * Responsible Gambling Settings/Limits * Username, Password, Security Questions and Answers * Occupation and Industry * Customer Service Records * Player ID (assigned by Casino Time) ## 5. How is Personal Information Used Casino Time collects, uses and discloses and otherwise Processes personal information for the reasons and the purposes set out in this Policy. In addition to providing you the terms in this Policy, when Casino Time collects personal information from patrons for other purposes, we provide a “Notice of Collection” which explains the specific purposes of collection for a given program, service or offering. Casino Time collects, uses, and discloses and otherwise Processes player account information on behalf of and as an agent to iGO to satisfy Casino Time and iGO’s obligations at law. For example, Casino Time will collect certain of the above personal information, and if provided by you, your country of residence, business telephone number, employer’s name, employer’s address, citizenship, and alias/preferred name for the purposes of complying with our anti-money laundering obligations under applicable law. ### How it is Used for Internet Gaming Account Purposes? In general, and in addition to other processing as described throughout this Policy, the processing of personal information for administering Internet Gaming accounts can be organized into three main phases;
(a) Registration & Account Activation – when you choose to register for an account, Casino Time will collect certain identity, demographic, employment, and contact information. This information will be used to administer your account throughout your use of the Internet Gaming service, to confirm your eligibility for registration, and for anti-fraud and legal compliance purposes. Additionally, Casino Time will seek to confirm that the device you use to register is located in Ontario, as Casino Time’s Internet Gaming service is only available to persons residing in Ontario and who use the service while physically located in Ontario.

Prior to account activation, Casino Time will seek to verify the identity of a registering individual. To confirm your identity, Casino Time shares some of the information you provide at registration with a third-party identity verification service(s). If your identity cannot be verified with the information you provided at registration, we may require that you submit additional information or proof of identity prior to the completion of registration. Access to this additional information will only be provided to Casino Time personnel who require such access to complete the identity verification process. The information will be retained in a manner consistent with this Policy and Casino Time’s internal retention and information security procedures.
(b) Use of the service – after registration and account activation, you will be able to securely log into Casino Time’s Internet Gaming service. When you log in, Casino Time will seek to confirm that the device you are using is located in Ontario, as Casino Time’s Internet Gaming service is only available to persons residing in Ontario and who use the service while physically located in Ontario. Additionally, information about your use, such as transaction data, responsible gambling settings and play history will be retained and used to provide you access to your overall account history, for responsible gambling purposes including monitoring, analyzing, and communicating with you about your use of the Internet Gaming service, and for purposes as otherwise described throughout this policy.
(c) Purchasing and Withdrawals – while logged in to your Internet Gaming account, you will have the option to purchase certain Casino Time products and services. Should you choose to do so, Casino Time will collect payment card information and payment through its third-party secure payment providers. Transaction information will be processed to provide you access to a history of your transactions, for anti-fraud purposes, for compliance with applicable law and regulation, and as otherwise described throughout this Policy.

Should you choose to withdraw funds from your Internet Gaming account, Casino Time will collect bank account information from you to process your withdrawal requests. This information will be shared with Casino Time’s partner financial institution to process your withdrawal request. Where permitted or required for compliance with applicable law, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, Casino Time may collect additional Information through a third-party identity verification service.

In addition, you will be required to upload supporting documentation to confirm your withdrawal information. Access to uploaded supporting documentation will only be provided to Casino Time personnel who require such access to complete the withdrawal process. The documentation will be retained in a manner consistent with this Policy and Casino Time’s internal retention and information security procedures.
## 6. Referrals Including ‘Tell a Friend’ If you choose to use our referral program to tell a friend about our Service, Casino Time will ask you for your friend’s name and email address. Casino Time will send your friend a one-time email on your behalf inviting them to sign up for our Services. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program, and we do not use the names or email addresses submitted in these circumstances for any other purpose without consent to do so. You are responsible for ensuring that you only submit email addresses of individuals with whom you have a personal or family relationship and who would want to receive the message. ## 7. Politically Exposed Person (“PEP”) and/or Head of an International Organization If you attest that you are a Politically Exposed Person (“PEP”), the Head of an International Organization (“HIO”) or a family member of a close associate of a PEP or HIO, as those terms are defined in the terms and Conditions, you will be required to provide additional information such as your source of funds, your source of wealth, the nature of connection to the PEP or HIO if you are a family member or close associate of a PEP or HIO, the office or position of the PEP/HIO, the PEP or HIO organization/institution name and, if you are a family member or close associate of a PEP or HIO, the nature of the relationship between the family member and close associate of the PEP or HIO. Such information is collected on behalf of iGaming Ontario and may be shared with other Operators as part of the enterprise level player monitoring. ## 8. Other Reasons Why Casino Processes Personal Information? In addition to the foregoing, the most common purposes for Casino Time’s collection of personal information can be organized into four main categories:
(a) For program, service, or product administration – to provide you with service you have requested or to administer your participation in a particular program. That may include using personal information for the following purposes:
(i) Uniquely identifying and authenticating patrons to provide them access to their account and to be sure prizes, payments or other features of a service are properly administered
(ii) To deliver marketing and promotional material, including offerings tailored to the recipient
(iii) To administer loyalty or responsible gambling programs
(iv) To provide customer service, facilitate payments and awarding prizes, and otherwise respond to patron requests, inquiries, comments, and concerns
(v) To customize the presentation of our products, services, webpages, and applications to individual users, and
(vi) As otherwise described in a Notice of Collection and/or permitted under the Acts.
(b) To analyze and improve upon our products, services, programs, offerings, and processes – in addition to day-to-day administration of the services you engage with, we may also use personal information to assist us in evaluating and improving our products, services, programs, offerings and processes. That may include using personal information for purposes such as:
(i) To research the operational effectiveness and business viability of current and prospective products, programs, campaigns, and services.
(ii) To better understand the interests of current and prospective customers
(iii) To tailor or personalize offers and information (in accordance with the Acts) to receiving patrons
(iv) To engage in responsible gambling research.
(c) To help Casino Time comply with applicable law and to maintain the integrity of Casino Time’s operations – in certain circumstances, Casino Time may be permitted or required to collect, use, disclose and otherwise process personal information so that it can comply with applicable law, or to maintain the integrity of its business. That could include using personal information for purposes such as:
(i) Collecting, organizing, and assessing patron information and transaction data to meet record keeping, patron monitoring, risk mitigation and reporting requirements under applicable law, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act
(ii) Administering responsible gambling programs; and
(iii) As otherwise required or permitted under applicable law, regulation or as detailed in a Notice of Collection.
(d) Other Purposes – in addition to the foregoing, we may use the information we collect for the following purposes including:
(i) Validating your identity
(ii) Sending you push notification or e-mails to provide you with alerts and updates about your Account Services
(iii) Monitoring, accessing, and recording gaming-related activity, such as using automated software to report on any processes or programs running on your computer that have been identified as prohibited software to prevent the abuses caused by BOTs
(iv) Conducting statistical or demographic analysis
(v) Processing and tracking gaming and non-gaming transactions
(vi) Complying with legal and regulatory requirements
(vii) Customizing your experience with the Services
(viii) Protecting and defending Casino Time and Casino Time Affiliates against legal actions or claims
(ix) Preventing fraud
(x) Debt collection
(xi) Satisfying contractual obligations
(xii) Safety and security purposes including cooperating with law enforcement or other government agencies for purposes of national security, public safety or matters of public importance when we believe that disclosure of information is necessary to protect the public interest

Location, Tracking and Profiling Information Casino Time collects the types of personal information, which is required by law, or otherwise reasonably necessary to achieve the purposes set out in this Policy. “Under FIPPA, “personal information” means recorded information about an identifiable individual.” The following provides some examples of personal information Casino Time may collect:
(a) Identity information (such as full name, Driver’s Licence number or other official ID number, etc.)
(b) Demographic information (such as your age)
(c) Contact information (such as your email address and phone number)
(d) Location information (such as your address and the location of a device you use to access your website or applications)
(e) Professional information (such as your occupation and industry of employment)

(g) Transaction information (such as play or payment history, customer service history, or other information related to transactions between you and Casino Time.)
Tracking Technologies obtain your physical location by accessing your IP address, MAC address, RFID, hardware embedded article/production number, embedded software number (such as UUID), Wi-Fi positioning system, or device GPS coordinates. The Tracking Technologies report to us, our service providers and/or iGaming Ontario the physical and geographic location of the computer or Internet connected device from which you are accessing the Services. Your physical location will be reported to us, our services providers and/or iGaming Ontario when you use the Services. You may withdraw this consent at any time by turning off the location settings or by notifying us in writing that you would like to withdraw such consent. If you turn off the location settings or withdraw such consent, you will not be able to access the Services. Your location information is retained for no longer than necessary for the purposes set out herein or as otherwise required to meet legal or business requirements. Location coordinate data is transmitted via Transport Layer Security (“TLS”) and/or Secure Socket Layer (“SSL”) technology and stored in secured server managed by us and our geolocation and operating partners. Neither we nor our partners will resell your location information to any third party, except that we reserve the right to provide location information as necessary to satisfy any law, regulation or government agency request. ## 10. Text Messages and Other Electronic Communications If you provide Casino Time a cell phone number and expressly consent to receive text messages from Casino Time, you expressly consent to receive recurring informational and transactional texts and marketing messaging, including texts made using an auto dialer, from or on behalf of Casino Time to the number you provided. By providing a cell phone number and expressly consenting to receive SMS messages from Casino Time, you warrant and represent that you are either the account owner of the cell phone number you provide to us, or you have the express permission of the account holder to provide the number and to consent to automated texts to that number. Although there is no fee associated with this service, your carrier may charge you for each message you receive in accordance with your calling plan. You agree that we are not responsible in any way for such charges. Obtaining Information from Affiliates Casino Time may obtain information about you from land-based gaming affiliates and from third parties including our business partners and other companies and individuals that you refer to our Services. This information may include, among other things, information related to your land-based rewards account that we need to make the services available to you, information to set up your wagering account and information necessary to connect your wagering account to your account with one or more of our business partners. ## 12. Persons Under 19 The Services are for use by persons 19 or older. If you are under 19, you may not access, attempt to access, or use the Service. We do not knowingly collect or allow the collection of personal information via the services from persons under 19. If a parent or guardian becomes aware that his or her children under the age of 19 has provided us with personal information, the parent or guardian may contact us at the details set out below “Contact Us” section to have such personal information deleted. ## 13. Transfers and Disclosures of Personal Information Casino Time may disclose personal information to law enforcement, government regulators, and other third parties where permitted or required by law. From time to time, Casino Time may disclose personal information to service providers acting on its behalf to enable them to perform specific types of processing and other specialized services in accordance with Section 40(2) of FIPPA or otherwise to provide services to and on behalf of Casino Time. To provide Internet Gaming products and services, your personal information may be disclosed to third-party service providers assisting Casino Time in the administration of Internet Gaming. Examples of such third parties include: * **Identity Verification Services** – to prevent fraudulent activity and for compliance with applicable law, Casino Time shares your name, date of birth, phone number and address with a third-party identity verification service at registration or in the course of administering active Internet gaming accounts. This process is done through third-party integration using government issued identification provided at the time of registration. Identity verification Services may share this information with your telecommunications provider to validate identity. * **Content Providers** – to provide casino games and sports wagering, Casino Time shares your language preferences and a unique alphanumeric identifier assigned by Casino Time to your Internet Gaming account with third-party content providers. * **Address Verification** – to confirm your address is entered correctly at registration, Casino Time shares the address with an address verification service integrated into the platform. The other information you provide Casino Time is not shared for address verification. * **Payment Provider** – to facilitate payment, your payment card information is collected and processed by Casino Time’s secure payment provider. Your full payment card information is retained by the secure payment provider and is not shared with or stored by Casino Time. * **Banking Provider** – to facilitate your requests for withdrawals of funds, the bank account information you provide is shared with Casino Time’s partner financial institution. This information is used to ensure your withdrawals are deposited into your account. * **Geo-Location Provider** – the Casino Time Internet Gaming service is only available to eligible individuals who are physically located in Ontario. Accordingly, your connection information and the location of the device you use to access the internet Gaming service may be shared with Casino Time’s third-party geo-location service. This information may also be shared with Casino Time’s marketing vendor for geo location targeted marketing if a player has agreed to marketing communication. * **Responsible Gambling Researchers** – from time to time, Casino Time shares de-identified play data with responsible gambling researchers. * **Credit Reporting agencies and Credit Reference Bureaus**, including for conducting name, address, and age checks. Accuracy of Your Personal Information Casino Time will use reasonable efforts to ensure your personal information is up-to-date and accurate. We ask that you update your information through your account whenever your information is incomplete, out-of-date, or otherwise changes. Subject to applicable law, you have the right to access, update, and correct inaccuracies in your personal information which is in our custody and control by contacting us at customersupport@casinotime.ca. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records. Please contact the Casino Time Support Center at customersupport@casinotime.ca to advise Casino Time of any updates or corrections you would like to make regarding your personal information. ## 17. Retention and Storage Personal information collected by Casino Time is retained in accordance with applicable law and Casino Time’s Records Retention Policies. After the applicable retention period for records containing personal information has elapsed, the records are securely disposed of in accordance with Casino Time information security policies. Without limiting the foregoing, in certain circumstances as described in the Casino Time Player Agreement, your account may be deemed inactive or dormant. In such circumstances, personal information will be retained in accordance with applicable law and Casino Time’s records retention policies. After the applicable retention period for records containing personal information has elapsed, the records are securely disposed of in accordance with Casino Time information security policies. ## 18. Security and Limits on Security Casino Time has implemented physical, procedural, and technological security measures to protect the personal information in its custody and under its control. Access to personal information at Casino Time is restricted to individuals who require such access to perform their duties. Furthermore, Casino Time imposes information security requirements on third-party vendors and service providers to whom personal information is disclosed. Non-gaming information and non-live gaming data collected by us through the Services is stored on secure services located in Canada (Ontario and Quebec), United States (Virginia, New Jersey, Texas), Europe (Netherlands). Internet wagering and live game play data collected by us through the Services is stored on servers located in Europe (Netherlands) and is protected by firewalls and other industry standard security measures. These security measures are intended to protect our servers from unauthorized access. However, no security system is impenetrable, and these systems could become accessible in the event of a security breach. Casino Time has the controls in place that are designed to detect potential data breaches, contain and minimize the loss of data, and conduct forensic investigations of a breach. Casino Time will provide you notice in the event of an incident that materially impacts your personal information (a “Data Incident”). As required by law, we will notify you, iGaming Ontario, and any other applicable regulatory authority about the data Incident, and we will aid iGaming Ontario and any applicable authorities in the management and handling of the data incident. Personal Information Processed and Stored Outside Canada Personal information collected and Processed by Casino Time and/or Casino Time’s service providers may be Processed outside Canada and in other jurisdictions as required or permitted by applicable laws. Information stored and otherwise Processed outside Canada by Casino Time and/or its service provider is subject to the laws of the jurisdiction in which the personal information is processed and/or stored, including the rights of law enforcement and other government authorities to access the personal information. ## 20. Casino Time Privacy and Cookies Policy

This Casino Time Privacy and Cookie Policy (hereafter, the “Policy”) is incorporated into and forms Section 3 part (iv) of the Casino Time Terms & Conditions(the “Player Agreement”). Any conflict or inconsistency between this Policy and the terms of the Player Agreement shall be resolved in accordance with Section 3 of the Player Agreement.

1. What Does This Policy Govern?

This Policy governs the collection, use, disclosure, retention, and other processing of personal information by Casino Time, including through Casino Time products and services, on Casino Time websites (“Websites”) and via mobile applications (collectively, the offerings via the Website, the mobile applications and Casino Time’s other products and services, shall be referred to in this Policy as the “Services”). This Policy explains what types of personal information are collected, how the personal information may be used (for what purposes), to whom the personal information may be transferred or disclosed, and how you can ask us questions about our privacy practices. Generally speaking, “personal information” means information about an identifiable individual.

If you do not want us to collect, use, or share your information in the ways described in this Policy, please do not use the Services. By using the Services, you consent to the collection and use of your information (including personally identifiable information) by us as identified herein, in compliance with this Policy and the terms and conditions for the Services.

2. Context for Casino Time’s Personal Information Practices

Casino Time is running Casino Time Website and providing Casino Time Offerings as part of the open and regulated internet gaming (iGaming) market in Ontario conducted and managed by iGO In the course of providing the Services, in relation to player account, Casino Time collects, uses and discloses personal information on behalf of and as agent to iGaming Ontario.

Casino Time collects personal information in accordance with The Freedom of Information and Protection of Privacy Act (Ontario) (FIPPA), Personal Information Protection and Electronic Documents Act (“Acts”) and other applicable privacy laws, and under the authority of Ontario Regulation 722/21 made under the Alcohol and Gaming Commission, and the operating agreement entered into between Casino Time and iGaming Ontario, as each of the foregoing is amended and/or replaced from time to time.

3. Definitions

If not otherwise defined in this Policy, the following terms when used in this Policy shall have the meanings set out beside them.

Cookies – A packet of data sent by a web server to a browser, which is returned by the browser each time it subsequently accesses the same server, used to identify the user, or track their access to the server.

Device – piece of portable electronic equipment that can connect to the internet, such as a smartphone, tablet, or laptop computer. FIPPA – Freedom of Information and Protection of Privacy Act provides a right of access to records held by public bodies and regulates how public manage personal information.

HIO – Person who currently holds or has held within the last 5 years the specific office or position of head of an international organization.

iGO – Internet Gaming of Ontario, working with the Government of Ontario and the Alcohol and Gaming Commission of Ontario (AGCO) to establish a new online gaming market that helps protect consumers gambling through private companies (Operators).

PCMLTFA – Proceeds of Crime (Money Laundering) and Terrorist Financing Act implements specific measures to detect and deter money laundering and financing of terrorist activities to facilitate the investigation or prosecution of money laundering and terrorist financing offences.

Player Account – Player’s account of notional funds corresponding to Canadian dollars that is maintained on the iGaming Platform, and also includes the Player’s registration information, deposit and withdrawal transaction history, and game-play information that the Player can access through CasinoTime.ca.

PEP – Politically Exposed Person is an individual who has a high-ranking job in government or some other type of political position. Payment Service Provider – financial entity that is authorized to process transactions between Player and Casino Time.

Processing – the collection, use, disclosure, transfers, storage, and other processing of personal information.

SMS – text messaging service component of most telephone, internet, and mobile devices.

Third Party – An individual or entity that is involved in a transaction but is not one of the principles and, thus, has a lesser interest in the transaction.

4. What Personal Information is Collected?

Casino Time collects the types of personal information, which is required by law, or otherwise reasonably necessary to achieve the purposes set out in this Policy. “Under FIPPA, “personal information” means recorded information about an identifiable individual.”

The following provides some examples of personal information Casino Time may collect:

(a) Identity information (such as full name, Driver’s Licence number or other official ID number, etc.)
(b) Demographic information (such as your age)
(c) Contact information (such as your email address and phone number)
(d) Location information (such as your address and the location of a device you use to access your website or applications)
(e) Professional information (such as your occupation and industry of employment)
(f) Banking or financial information (such as payment or withdrawal account information) and
(g) Transaction information (such as play or payment history, customer service history, or other information related to transactions between you and Casino Time.)

You can visit Casino Time’s websites without registering for an Internet Gaming account (“Internet Gaming”). However, certain products and services available through Casino Time websites require that you register for an Internet Gaming account. Should you choose to register for an Internet Gaming account, Casino Time will process your personal information in the course of administering your account.

The following types of information may be collected throughout your registration for, and use of, an Internet Gaming account:

  • Full Name
  • Home Address
  • Date of Birth
  • Email Address
  • Phone Number
  • Transaction and Play History
  • Supporting Documents to verify Identity (government issued identification including Driver’s Licence, Passport etc.)
  • Device Information and Connection IP Address
  • Payment Information
  • Withdrawal Account Information
  • Language and Marketing Preferences
  • Device Location
  • Supporting Documents to Confirm Withdrawal Account ownership
  • Responsible Gambling Settings/Limits
  • Username, Password, Security Questions and Answers
  • Occupation and Industry
  • Customer Service Records
  • Player ID (assigned by Casino Time)

5. How is Personal Information Used

Casino Time collects, uses and discloses and otherwise Processes personal information for the reasons and the purposes set out in this Policy. In addition to providing you the terms in this Policy, when Casino Time collects personal information from patrons for other purposes, we provide a “Notice of Collection” which explains the specific purposes of collection for a given program, service or offering.

Casino Time collects, uses, and discloses and otherwise Processes player account information on behalf of and as an agent to iGO to satisfy Casino Time and iGO’s obligations at law. For example, Casino Time will collect certain of the above personal information, and if provided by you, your country of residence, business telephone number, employer’s name, employer’s address, citizenship, and alias/preferred name for the purposes of complying with our anti-money laundering obligations under applicable law.

How it is Used for Internet Gaming Account Purposes?

In general, and in addition to other processing as described throughout this Policy, the processing of personal information for administering Internet Gaming accounts can be organized into three main phases;

(a) Registration & Account Activation – when you choose to register for an account, Casino Time will collect certain identity, demographic, employment, and contact information. This information will be used to administer your account throughout your use of the Internet Gaming service, to confirm your eligibility for registration, and for anti-fraud and legal compliance purposes. Additionally, Casino Time will seek to confirm that the device you use to register is located in Ontario, as Casino Time’s Internet Gaming service is only available to persons residing in Ontario and who use the service while physically located in Ontario.

Prior to account activation, Casino Time will seek to verify the identity of a registering individual. To confirm your identity, Casino Time shares some of the information you provide at registration with a third-party identity verification service(s). If your identity cannot be verified with the information you provided at registration, we may require that you submit additional information or proof of identity prior to the completion of registration. Access to this additional information will only be provided to Casino Time personnel who require such access to complete the identity verification process. The information will be retained in a manner consistent with this Policy and Casino Time’s internal retention and information security procedures.
(b) Use of the service – after registration and account activation, you will be able to securely log into Casino Time’s Internet Gaming service. When you log in, Casino Time will seek to confirm that the device you are using is located in Ontario, as Casino Time’s Internet Gaming service is only available to persons residing in Ontario and who use the service while physically located in Ontario. Additionally, information about your use, such as transaction data, responsible gambling settings and play history will be retained and used to provide you access to your overall account history, for responsible gambling purposes including monitoring, analyzing, and communicating with you about your use of the Internet Gaming service, and for purposes as otherwise described throughout this policy.
(c) Purchasing and Withdrawals – while logged in to your Internet Gaming account, you will have the option to purchase certain Casino Time products and services. Should you choose to do so, Casino Time will collect payment card information and payment through its third-party secure payment providers. Transaction information will be processed to provide you access to a history of your transactions, for anti-fraud purposes, for compliance with applicable law and regulation, and as otherwise described throughout this Policy.

Should you choose to withdraw funds from your Internet Gaming account, Casino Time will collect bank account information from you to process your withdrawal requests. This information will be shared with Casino Time’s partner financial institution to process your withdrawal request. Where permitted or required for compliance with applicable law, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, Casino Time may collect additional Information through a third-party identity verification service.

In addition, you will be required to upload supporting documentation to confirm your withdrawal information. Access to uploaded supporting documentation will only be provided to Casino Time personnel who require such access to complete the withdrawal process. The documentation will be retained in a manner consistent with this Policy and Casino Time’s internal retention and information security procedures.

6. Referrals Including ‘Tell a Friend’

If you choose to use our referral program to tell a friend about our Service, Casino Time will ask you for your friend’s name and email address. Casino Time will send your friend a one-time email on your behalf inviting them to sign up for our Services. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program, and we do not use the names or email addresses submitted in these circumstances for any other purpose without consent to do so. You are responsible for ensuring that you only submit email addresses of individuals with whom you have a personal or family relationship and who would want to receive the message.

7. Politically Exposed Person (“PEP”) and/or Head of an International Organization

If you attest that you are a Politically Exposed Person (“PEP”), the Head of an International Organization (“HIO”) or a family member of a close associate of a PEP or HIO, as those terms are defined in the terms and Conditions, you will be required to provide additional information such as your source of funds, your source of wealth, the nature of connection to the PEP or HIO if you are a family member or close associate of a PEP or HIO, the office or position of the PEP/HIO, the PEP or HIO organization/institution name and, if you are a family member or close associate of a PEP or HIO, the nature of the relationship between the family member and close associate of the PEP or HIO. Such information is collected on behalf of iGaming Ontario and may be shared with other Operators as part of the enterprise level player monitoring.

8. Other Reasons Why Casino Processes Personal Information?

In addition to the foregoing, the most common purposes for Casino Time’s collection of personal information can be organized into four main categories:

(a) For program, service, or product administration – to provide you with service you have requested or to administer your participation in a particular program. That may include using personal information for the following purposes:
(i) Uniquely identifying and authenticating patrons to provide them access to their account and to be sure prizes, payments or other features of a service are properly administered
(ii) To deliver marketing and promotional material, including offerings tailored to the recipient
(iii) To administer loyalty or responsible gambling programs
(iv) To provide customer service, facilitate payments and awarding prizes, and otherwise respond to patron requests, inquiries, comments, and concerns
(v) To customize the presentation of our products, services, webpages, and applications to individual users, and
(vi) As otherwise described in a Notice of Collection and/or permitted under the Acts.
(b) To analyze and improve upon our products, services, programs, offerings, and processes – in addition to day-to-day administration of the services you engage with, we may also use personal information to assist us in evaluating and improving our products, services, programs, offerings and processes. That may include using personal information for purposes such as:
(i) To research the operational effectiveness and business viability of current and prospective products, programs, campaigns, and services.
(ii) To better understand the interests of current and prospective customers
(iii) To tailor or personalize offers and information (in accordance with the Acts) to receiving patrons
(iv) To engage in responsible gambling research.
(c) To help Casino Time comply with applicable law and to maintain the integrity of Casino Time’s operations – in certain circumstances, Casino Time may be permitted or required to collect, use, disclose and otherwise process personal information so that it can comply with applicable law, or to maintain the integrity of its business. That could include using personal information for purposes such as:
(i) Collecting, organizing, and assessing patron information and transaction data to meet record keeping, patron monitoring, risk mitigation and reporting requirements under applicable law, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act
(ii) Administering responsible gambling programs; and
(iii) As otherwise required or permitted under applicable law, regulation or as detailed in a Notice of Collection.
(d) Other Purposes – in addition to the foregoing, we may use the information we collect for the following purposes including:
(i) Validating your identity
(ii) Sending you push notification or e-mails to provide you with alerts and updates about your Account Services
(iii) Monitoring, accessing, and recording gaming-related activity, such as using automated software to report on any processes or programs running on your computer that have been identified as prohibited software to prevent the abuses caused by BOTs
(iv) Conducting statistical or demographic analysis
(v) Processing and tracking gaming and non-gaming transactions
(vi) Complying with legal and regulatory requirements
(vii) Customizing your experience with the Services
(viii) Protecting and defending Casino Time and Casino Time Affiliates against legal actions or claims
(ix) Preventing fraud
(x) Debt collection
(xi) Satisfying contractual obligations
(xii) Safety and security purposes including cooperating with law enforcement or other government agencies for purposes of national security, public safety or matters of public importance when we believe that disclosure of information is necessary to protect the public interest

9. Location, Tracking and Profiling Information

Casino Time collects the types of personal information, which is required by law, or otherwise reasonably necessary to achieve the purposes set out in this Policy. “Under FIPPA, “personal information” means recorded information about an identifiable individual.”

The following provides some examples of personal information Casino Time may collect:

(a) Identity information (such as full name, Driver’s Licence number or other official ID number, etc.)
(b) Demographic information (such as your age)
(c) Contact information (such as your email address and phone number)
(d) Location information (such as your address and the location of a device you use to access your website or applications)
(e) Professional information (such as your occupation and industry of employment)
(f) Banking or financial information (such as payment or withdrawal account information) and
(g) Transaction information (such as play or payment history, customer service history, or other information related to transactions between you and Casino Time.)

Tracking Technologies obtain your physical location by accessing your IP address, MAC address, RFID, hardware embedded article/production number, embedded software number (such as UUID), Wi-Fi positioning system, or device GPS coordinates. The Tracking Technologies report to us, our service providers and/or iGaming Ontario the physical and geographic location of the computer or Internet connected device from which you are accessing the Services. Your physical location will be reported to us, our services providers and/or iGaming Ontario when you use the Services.

You may withdraw this consent at any time by turning off the location settings or by notifying us in writing that you would like to withdraw such consent. If you turn off the location settings or withdraw such consent, you will not be able to access the Services. Your location information is retained for no longer than necessary for the purposes set out herein or as otherwise required to meet legal or business requirements. Location coordinate data is transmitted via Transport Layer Security (“TLS”) and/or Secure Socket Layer (“SSL”) technology and stored in secured server managed by us and our geolocation and operating partners.

Neither we nor our partners will resell your location information to any third party, except that we reserve the right to provide location information as necessary to satisfy any law, regulation or government agency request.

10. Text Messages and Other Electronic Communications

If you provide Casino Time a cell phone number and expressly consent to receive text messages from Casino Time, you expressly consent to receive recurring informational and transactional texts and marketing messaging, including texts made using an auto dialer, from or on behalf of Casino Time to the number you provided. By providing a cell phone number and expressly consenting to receive SMS messages from Casino Time, you warrant and represent that you are either the account owner of the cell phone number you provide to us, or you have the express permission of the account holder to provide the number and to consent to automated texts to that number.

Although there is no fee associated with this service, your carrier may charge you for each message you receive in accordance with your calling plan. You agree that we are not responsible in any way for such charges.

You can stop receiving text messages from Casino Time at any time by visiting "Marketing preferences" in your "My Account"

11. Obtaining Information from Affiliates

Casino Time may obtain information about you from land-based gaming affiliates and from third parties including our business partners and other companies and individuals that you refer to our Services. This information may include, among other things, information related to your land-based rewards account that we need to make the services available to you, information to set up your wagering account and information necessary to connect your wagering account to your account with one or more of our business partners.

12. Persons Under 19

The Services are for use by persons 19 or older. If you are under 19, you may not access, attempt to access, or use the Service. We do not knowingly collect or allow the collection of personal information via the services from persons under 19. If a parent or guardian becomes aware that his or her children under the age of 19 has provided us with personal information, the parent or guardian may contact us at the details set out below “Contact Us” section to have such personal information deleted.

13. Transfers and Disclosures of Personal Information

Casino Time may disclose personal information to law enforcement, government regulators, and other third parties where permitted or required by law.

From time to time, Casino Time may disclose personal information to service providers acting on its behalf to enable them to perform specific types of processing and other specialized services in accordance with Section 40(2) of FIPPA or otherwise to provide services to and on behalf of Casino Time.

To provide Internet Gaming products and services, your personal information may be disclosed to third-party service providers assisting Casino Time in the administration of Internet Gaming. Examples of such third parties include:

  • Identity Verification Services – to prevent fraudulent activity and for compliance with applicable law, Casino Time shares your name, date of birth, phone number and address with a third-party identity verification service at registration or in the course of administering active Internet gaming accounts. This process is done through third-party integration using government issued identification provided at the time of registration. Identity verification Services may share this information with your telecommunications provider to validate identity.
  • Content Providers – to provide casino games and sports wagering, Casino Time shares your language preferences and a unique alphanumeric identifier assigned by Casino Time to your Internet Gaming account with third-party content providers.
  • Address Verification – to confirm your address is entered correctly at registration, Casino Time shares the address with an address verification service integrated into the platform. The other information you provide Casino Time is not shared for address verification.
  • Payment Provider – to facilitate payment, your payment card information is collected and processed by Casino Time’s secure payment provider. Your full payment card information is retained by the secure payment provider and is not shared with or stored by Casino Time.
  • Banking Provider – to facilitate your requests for withdrawals of funds, the bank account information you provide is shared with Casino Time’s partner financial institution. This information is used to ensure your withdrawals are deposited into your account.
  • Geo-Location Provider – the Casino Time Internet Gaming service is only available to eligible individuals who are physically located in Ontario. Accordingly, your connection information and the location of the device you use to access the internet Gaming service may be shared with Casino Time’s third-party geo-location service. This information may also be shared with Casino Time’s marketing vendor for geo location targeted marketing if a player has agreed to marketing communication.
  • Responsible Gambling Researchers – from time to time, Casino Time shares de-identified play data with responsible gambling researchers.
  • Credit Reporting agencies and Credit Reference Bureaus, including for conducting name, address, and age checks. To open an account for you, we will supply your personal information to the credit bureau via our KYC service provider, and they will provide us information about you which may include identity and information about your financial situation and financial history, shared credit details and fraud prevention information. Casino Time will use as a third- party service provider to verify the details of your government issued photo identification and proof of address documents as required by our anti-money laundering obligations under applicable law. We may also engage and transfer information to service providers to provide certain services to us or to perform certain services on our behalf including analytics, marketing, fulfillment, Know Your Client verification, etc. In some cases, service providers may collect or be provided with access to your information as reasonably necessary to perform such services on the condition that they not use or disclose your personal information for other purposes. Service providers processing of your personal information will be limited to what’s contemplated in this Policy.

Service providers who process personal information on behalf of Casino Time are contractually obliged to protect the privacy of Casino Time customers and to only process personal information for the specific purpose for which Casino Time provides instruction or permission.

Marketing and Advertising and Third-Party Service Providers

When you register for an account with Casino Time, you will have the option to sign-up to receive marketing information, including notifying you of special promotions, offers and events via push notifications, e-mail, and other means.

We may also link personal information (including your name, mobile phone number, and e-mail address) with non-personal information (including information collected through Tracking Technologies and Wi-Fi services as described above) and use such information for our own marketing purposes.

Casino Time uses third-party services to serve advertisements on various websites in the Province of Ontario. These third-party advertising services will collect non-personal information from you after you have seen our ad either by clicking on it or scrolling past it, such as:

  • Advertising identifiers
  • Cookie Identifiers
  • Device Identifiers
  • IP Addresses
  • Referral page URL and title
  • Geolocation information
  • Demographic data that may be associated with one of the above identifiers

Casino Time uses this information to tailor its marketing and advertising as well as for analytics and research. Information collected will allow us to create a profile to better provide our advertising to reach specific markets. This information is only retained as long as it is useful, otherwise, it is destroyed.

14. Disclosing Information to Business Partners For Marketing Purposes

We may share the information we collect with our business partners and other third parties for joint marketing purposes and/or our business partners’ (or our own) marketing purposes.

If you opt-out of permitting us to share your personal information with our business partners and other third parties for marketing purposes, if those third parties provided services to Casino Time for the purposes set out in this Policy, we may still share the information we collect with them to allow them to provide the services reasonably required to provide you the services you’ve requested such as processing transactions, fulfilling your requests, responding to your inquiries, etc.

15. Third-party websites and services

In some cases, our websites provide links to other sites created and maintained by other public and/or private sector organizations. We provide these links solely for your information and convenience. Casino Time is not responsible for the privacy practices of websites not administered by or on behalf of Casino Time.

You should review and understand the privacy policies posted on any linked sites you visit before using those sites or providing any personal information on them.

16. Accuracy of Your Personal Information

Casino Time will use reasonable efforts to ensure your personal information is up-to-date and accurate. We ask that you update your information through your account whenever your information is incomplete, out-of-date, or otherwise changes. Subject to applicable law, you have the right to access, update, and correct inaccuracies in your personal information which is in our custody and control by contacting us at customersupport@casinotime.ca. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records.

Please contact the Casino Time Support Center at customersupport@casinotime.ca to advise Casino Time of any updates or corrections you would like to make regarding your personal information.

17. Retention and Storage

Personal information collected by Casino Time is retained in accordance with applicable law and Casino Time’s Records Retention Policies. After the applicable retention period for records containing personal information has elapsed, the records are securely disposed of in accordance with Casino Time information security policies.

Without limiting the foregoing, in certain circumstances as described in the Casino Time Player Agreement, your account may be deemed inactive or dormant. In such circumstances, personal information will be retained in accordance with applicable law and Casino Time’s records retention policies. After the applicable retention period for records containing personal information has elapsed, the records are securely disposed of in accordance with Casino Time information security policies.

18. Security and Limits on Security

Casino Time has implemented physical, procedural, and technological security measures to protect the personal information in its custody and under its control. Access to personal information at Casino Time is restricted to individuals who require such access to perform their duties. Furthermore, Casino Time imposes information security requirements on third-party vendors and service providers to whom personal information is disclosed.

Non-gaming information and non-live gaming data collected by us through the Services is stored on secure services located in Canada (Ontario and Quebec), United States (Virginia, New Jersey, Texas), Europe (Netherlands). Internet wagering and live game play data collected by us through the Services is stored on servers located in Europe (Netherlands) and is protected by firewalls and other industry standard security measures.

These security measures are intended to protect our servers from unauthorized access. However, no security system is impenetrable, and these systems could become accessible in the event of a security breach. Casino Time has the controls in place that are designed to detect potential data breaches, contain and minimize the loss of data, and conduct forensic investigations of a breach. Casino Time will provide you notice in the event of an incident that materially impacts your personal information (a “Data Incident”). As required by law, we will notify you, iGaming Ontario, and any other applicable regulatory authority about the data Incident, and we will aid iGaming Ontario and any applicable authorities in the management and handling of the data incident.

Our employees and other authorized contractors have restricted access to personal information on a need-to-know basis and are required to take reasonable measures to ensure that unauthorized persons cannot view or access your personal information. Employees and contractors who violate our privacy policies are subject to disciplinary action, up to and including termination of employment.

As a standard security practice, Casino Time will take reasonable steps which are generally recognized in the industry to ensure that the communication methods used to support the services do not permit collection or communication by methods that have known security weaknesses or vulnerabilities.

In situations where your personal information is collected by third parties under contract with Casino Time for performance of their contractual duties and other purposes, we require such third parties to exercise reasonable care to protect that information and restrict the use of your personal information to the purposes for which it was provided. When we share your personal information with Casino Time Affiliates or third parties in accordance with the Policy, we require them to exercise reasonable care to protect such information and restrict the use of such information to the purposes for which it was provided to them.

No method of transmission over the Internet, or method of electronic storage is 100% secure. Casino Time therefore does not warrant, represent, or guarantee the absolute security personal information in our custody or under our control.

We cannot enforce or control the security of the computers, electronic devices, or electronic communication method that you may use to send e-mails and submit information to use over the Internet. You are responsible for ensuring that the computers, electronic devices and electronic communication methods you use will provide adequate security for communicating with us. Passwords should be strong and kept private. Any account information supplied to or received by Casino Time will be considered confidential and not shared without your prior consent. We are not responsible for the disclosure or interception of information that you send us before we receive it.

19. Personal Information Processed and Stored Outside Canada

Personal information collected and Processed by Casino Time and/or Casino Time’s service providers may be Processed outside Canada and in other jurisdictions as required or permitted by applicable laws.

Information stored and otherwise Processed outside Canada by Casino Time and/or its service provider is subject to the laws of the jurisdiction in which the personal information is processed and/or stored, including the rights of law enforcement and other government authorities to access the personal information.

20. Cookies and Website Log Data

In addition to any information that you choose to submit to us, we and/or selected third parties may use a variety of technologies that store, or access information already stored on your personal computer, laptop, tablet or mobile phone (each a “device”) whenever you visit or interact with our Internet Gaming website or applications.

Casino Time uses both session cookies (used only during your visit and expire when you close your browser) and persistent cookies (stored on your device for longer that just your visit) on its Internet Gaming website. Cookies used by Casino Time collect certain information about your device, such as its IP address, operating system and browser specifications, but do not collect personal information such as your name or email address.

Casino Time installs First Party cookies on devices that access its websites unless the browser used by the device has disabled the installation of cookies. The first party cookies Casino Time installs ensure the website functions as intended, and in some circumstances are necessary for Casino Time to provide services requested by website visitors. For example, enabling first party cookies is required to log in to your CasinoTime.ca Internet Gaming account, as first party cookies are used to support the log-in process.

Casino Time also installs Third Party cookies on devices that access its website unless the browser used by the device has disabled the installation of cookies. Third Party Cookies are used by Casino Time to analyze and improve the performance of our websites, offerings, and advertisements.

Subject to certain limitations, among other rights, you have the right to (i) request what personal information we collect, use, disclose and otherwise Process on you; (ii) access or correct Personal Information and Player Information retained by Casino Time and (iii) opt out of certain Processing.

For all information handling practices that are not required by the law or are not reasonably necessary to provide the Services you have requested or agreed to, you have the right to opt-out of such information handling practices.

In the event a Player exhausts Casino Time’s complaints process without what they believe to be a satisfactory resolution, the Player may request a copy of their case file, which Casino Time must aid iGO in the investigation and handling of that complaint, all in accordance with the CCDR.

DEFINITIONS

These Terms and Conditions replace any pre-existing Terms and Conditions that appeared on this Website or in connection with CASINO TIME.ca. In these Terms and Conditions:

  • “AGCO” means the Alcohol and Gaming Commission of Ontario and the successors thereof.
  • “AGCO Standards” means the Registrar’s Standards for Internet Gaming, as amended or replaced from time to time.
  • “Agreement” means these Terms and Conditions – Terms and Conditions of use for CASINO TIME.ca, as amended or replaced from time to time by CASINO TIME.
  • “Bonus Funds” means a notional amount corresponding to Canadian dollars that is loaded into a Player Account by CASINO TIME. Bonus Funds, subject to the applicable Bonus Funds Terms, can be used by a Player to play Pay-to-Play Games or Draw-Based Lottery Games Played Online including iBingo, or both, without charge to the Player.
  • “Bonus Funds Terms” means a notional amount corresponding to Canadian dollars that is loaded into a Player Account by CASINO TIME. Bonus Funds, subject to the applicable Bonus Funds Terms, can be used by a Player to play Pay-to-Play Games or Draw-Based Lottery Games Played Online including iBingo, or both, without charge to the Player.
  • “CASINO TIME” means Casino Time Inc. and the successors thereof.
  • “CASINO TIME.ca” means CASINO TIME's website and Mobile Applications through which select Games are made available to eligible Players from time to time.
  • “CASINO TIME Privacy and Cookie Policy” means the CASINOTIME.ca’s privacy and cookie policy, as amended or replaced by CASINO TIME from time to time.
  • “CASINO TIME IP Rights” means all intellectual property rights, including without limitation all Content and material supplied as part of the CasinoTime.ca website and the Software.
  • “Chargeback” means when a Player, a credit card issuing bank, or any other third-party payment solutions provider effects a reversal of charges in relation to the Player’s credit card or third-party deposit transaction.
  • “Closed Account” means a Player Account that has been closed by the Player.
  • “Close” or “Closure” means the act of a Player closing their Player Account as described in Section 12.4.
  • “Customer Support” means CASINOTIME.ca's customer support services.
  • “Deactivate” or “Deactivation” or “Deactivated Account” means that a Player Account has been set to a Deactivated Account status by CASINO TIME due to a Material Breach of this agreement.
  • “Dormant Account” means a Player Account that has not had a successfully completed Player-initiated Transaction for 24 consecutive months but does not include the Player Account of a Self-Excluded Individual or an Excluded Individual.
  • “Downtime” means when access to Casino Time.ca is limited or not available due to conducting software maintenance, upgrades or addressing issues.
  • “Event” has the meaning specified in the applicable Pay-To-Play Game Rules.
  • “Error Funds” has the meaning specified in Section 21. 
  • “Event” has the meaning specified in the applicable Pay-To-Play Game Rules. 
  • “Excluded Individual” means an individual who is not permitted to register an account or maintain an Account with CASINO TIME.ca.
  • “Financial Activity” is defined by the placing of bets anywhere on this website (voided/cancelled bets do not count).
  • “FINTRAC” means the Financial Transactions and Reports Analysis Centre of Canada and the successors thereof.
  • “Games” means, collectively Pay-to-Play Games and Play-for-Free Games.
  • “Gaming Day” means a day of the week commencing at 12:00:00 AM and ending at 11:59:59 PM.
  • “iGaming Platform” means the system that is used by CASINO TIME for the purpose of registering and administering Player Accounts, facilitating the playing of Games by Players, and paying Prizes.
  • “iGo” means iGaming Ontario and the successors thereof.
  • “iGo Policies” means the iGO Policies, standards, Guidance documents and requirements contained in the iGO Operating Agreement with Operators for iGaming in Ontario, as amended or replaced from time to time.
  • “Inactive Account” means a Player Account that has not recorded any Player-Initiated Transaction for a period of twelve (12) consecutive months. This does not include accounts that are participating in the Self-Exclusion program nor those who have been Excluded from the Site for other reasons.
  • “including” is deemed to mean “including without limitation” and shall not be deemed limited by the specific items listed.
  • “Mobile Applications” means any application developed by or on behalf of CASINO TIME that You can install on Your mobile device, such as mobile phone or tablet, and through which select Games are made available to You from time to time.
  • “Online Bingo” means Pay to Play Bingo accessed via the Casino Time website;
  • “Payment Service Provider” means a third party with whom we have an arrangement to process payment transactions;
  • “Pay-to-Play Game means any of the games made available through CASINOTIME.ca from time to time that: (i) constitutes a “lottery scheme” for purposes of the Criminal Code (Canada), (ii) requires the Player to place a bet or make a wager as a condition to entering the game, and (iii) affords the Player a chance to win a Prize but does not include any Draw-Based Lottery Game Played Online or any Play-for-Free Game. Examples of Pay-to-Play Games include Casino style games such as roulette and slots.
  • “Pay-to-Play Game Rules” means the terms, conditions, explanations, rules and procedures (for example, how a Prize is won, the value and odds of winning Prizes for an individual Pay-to-Play Game, the Prize tiers within a Pay-to-Play Game) issued by CASINO TIME from time to time (in addition to this Agreement) which apply to a particular Pay-to-Play Game and which are designated by CASINO TIME as Pay-to-Play Game Rules. Subject to Section 3, the Pay-to-Play Game Rules are incorporated into and form part of this Agreement.
  • “Player” means an individual who has successfully registered a Player Account and includes Excluded Players, Dormant Player, Inactive Players or a Closed Account Player.
  • “Player Account” means a Player's account of notional funds corresponding to Canadian dollars that is maintained on the iGaming Platform, and also includes the Player's registration information, deposit and withdrawal transaction history, and game-play information that the Player can access through CasinoTime.ca.
  • “Player Contact Information” means a Player's contact information that is associated with a Player Account and stored in the iGaming Platform at the relevant time including, for example, the Player's name, e-mail address, mailing address and telephone number.
  • “Play-for-Free Game” means any of the free games made available through CASINOTIME.ca from time to time that contain some of the features of a “lottery scheme” for purposes of the Criminal Code (Canada) but do not afford a chance to win a Prize or require any payment to play.
  • “Player Initiated Transaction” means:
    1. a deposit of funds by the Player for the purpose of funding the Player Account;
    2. a withdrawal of Unutilized Funds from the Player Account; or
    3. a purchase for Pay-to-Play Game, including a Future Game Transaction that has not expired or been suspended due to insufficiency of Unutilized Funds or for any other reason.
    For the avoidance of doubt, a Play-for-Free Game is not considered a Player-Initiated Transaction.
  • “Service” or “Services” means the availability and provision of Software that enables You to play at CASINO TIME.ca or Mobile Casino using the Internet in connection with Your use of the mobile applications, online and mobile games, being prescribed online lottery schemes iGaming Ontario is authorized to conduct and manage, Your participation in promotions and giveaways that may be sponsored by either us or third party companies, Your interactions with the server software, web technologies and branded websites used to provide any of the above and any communications You may have related thereto and any other related services;
  • “Self-Excluded Individual” is an individual who is actively enrolled in the Self-Exclusion Program;
  • “Self-Exclusion” means the program and associated processes through which Player’s voluntarily elect to exclude themselves from gaming sites for a prescribed period of time.
  • “Software” means any software owned or licensed that must be downloaded or otherwise used in order for You to participate at CASINO TIME.ca;
  • “Suspend”, “Suspension” or “Suspended Account” means a Player Account that has been set to a Suspended Status by Casino Time for further investigation purposes.
  • “Unutilized Funds” means any notional funds corresponding to Canadian dollars that are credited to a Player Account, including Prizes but excluding Bonus Funds, that have not been used by the Player.
  • “Username and Password” means a unique combination of identifiers created You that is used by You to identify yourself to the iGaming Platform each time You access Your Player Account.
  • “We”, “us” or “our” means Casino Time Inc., which is the owner and operator of CASINO TIME.ca.
  • “Week” means the seven-day period commencing on Monday at 12:00:00 AM and ending on Sunday at 11:59:59 PM.
  • “You” or “Your” means any person who seeks to access or use CASINO TIME.ca.

1. YOUR PARTICIPATION AT CASINO TIME.ca

This document contains the terms and conditions that govern the use of the CasinoTime.ca online gaming platform. By checking the “accept” box, You are confirming You understand and agree to be bound by the terms and conditions of this Agreement. If You do not agree with any of the terms and conditions, You:

  1. are not permitted to register an account with CasinoTime.ca, and
  2. if You already have a Player Account , You are not permitted to log into Your Player Account and play any Games on CasinoTime.ca.

1.2 CASINO TIME reserves the right to revise this Agreement from time to time in such manner as CASINO TIME, in its sole discretion, determines to be appropriate. CASINO TIME will post a notice on CASINOTIME.ca advising You when this Agreement has been revised and prior to logging into Your Player Account, You will be required to acknowledge and agree to be bound by the revised terms and conditions from and after that date. You are responsible for familiarizing yourself with all terms and conditions of this Agreement and ensuring that You understand and agree to be bound by them prior to registering an account with CASINOTIME.ca or logging-in to Your Player Account.

1.3 If You breach or otherwise fail to comply with the terms and conditions of this Agreement, CASINO TIME will have the right to exercise any or all remedies described in this Agreement or otherwise available to it at law or in equity. Those remedies may include, for example,

  1. the right to terminate Your Player Account,
  2. to lock, Suspend, and/or Deactivate Your Player Account, and
  3. to retain any or all Unutilized Funds associated with Your Player Account.

1.4 This agreement shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada.

1.5 Each provision of this agreement shall be valid and enforceable to the fullest extent permitted by law. If any provision of this agreement is declared invalid, unenforceable, or illegal by a court of competent jurisdiction, such provision may be severed and such invalidity, unenforceability or illegality shall not prejudice or affect the validity. enforceability and legality of the remaining provisions of this agreement.

1.6 Participation at CASINO TIME.ca, access and use of the Website and use of Services offered by us is at Your sole option, discretion and risk.

1.7 Internet Gambling may be illegal in Your Jurisdiction. CASINO TIME.ca is not intended to enable You to contravene applicable law and is only to be used if You are 19+ and located in the Province of Ontario.

1.8 CASINO TIME.ca cannot process bets for individuals residing outside of the Province of Ontario.

The following individuals are not eligible to participate at CASINO TIME.ca or to otherwise use the Services, and by registering You acknowledge and confirm that each of the following categories does not apply to You:

  1. An individual who is physically situated outside the Province of Ontario;
  2. individual under 19 years of age. We reserve the right to ask for Your proof of age and suspend Your Account until satisfactory documentation is provided;
  3. An individual that is participating in a self-exclusion process that applies to the Website;
  4. An individual who has been restricted from accessing the Website or playing a lottery scheme as a condition of a court order;
  5. An individual has been excluded from the Website under subsection 3.6(1) of the Gaming Control Act, 1992;
  6. Officers, members of the board of directors, or partners of Casino Time Inc.;
  7. Executives or staff of a trade union who represent or negotiate on behalf of employees employed by Casino Time.ca;
  8. Employees of registered suppliers who maintain or repair gaming equipment for the Website; and
  9. Members or employees of the Alcohol and Gaming Commission of Ontario, and officers, members of the board of directors, or employees of Ontario Lottery and Gaming Corporation or iGO, unless they are within the description set out in subsection 22(6) of Ontario Regulation 78/12.

1.9 Individuals described above in Paragraph 1.8 are not eligible for prizes with the exception of self-excluded individuals.

1.10 We do not warrant the legality of Your participation at CASINO TIME.ca in terms of the laws of Your Jurisdiction.

1.11 We have the right to request that You furnish us with proof of Your identity and age as a condition precedent to us allowing You to participate at CASINO TIME.ca. Additional personal information requested at time of Registration includes Your Full Name, Date of Birth, Telephone Number, email Address, Descriptive Occupation, Citizenship, Country of Residence. All information supplied when registering with the Website or otherwise required to access CASINO TIME.ca must be accurate and complete in all respects.

1.12 You hereby authorize us and our designated agents as and when we require, to confirm Your identity and Your right to use the monies that You wager at CASINO TIME.ca.

1.13 You may not open and maintain more than one account at any point in time.

1.14 CASINO TIME.ca, at its discretion, reserves the right to pay any winnings in Canadian Dollars, to require any and all bets or plays to be in Canadian Dollars, to facilitate all purchases using Canadian Dollars, and to require all withdrawals to be in Canadian Dollars.

1.15 We have the right to verify Your Account information at any time and suspend Your Account pending adequate verification. You are asked to keep Your registration details up to date. If You change Your address, email, phone number or any other contact or personal information You are obligated to contact Player Support in order to update Your Account information.

1.16 You agree to receive communications from CASINO TIME.ca and its marketing agents.

1.17 CASINO TIME.ca does not allow Players to gamble on credit. However, currency usable at CASINO TIME.ca may be available for purchase using credit or debit cards. Neither this nor any part of these Terms and Conditions should, in any way, be construed to imply or infer that Players should seek additional credit in order to play any game or use any feature on CASINO TIME.ca.

1.18 CASINO TIME.ca allows You to choose Your own user name and password combination, subject to any requirements we may have. You are asked to keep this information confidential and not share it with third parties, nor allow third parties to access Your Account. You are responsible for all actions carried out through Your Account if Your user name and password have been entered correctly. We will not be held liable for security weaknesses on devices or shared passwords. Players will refrain from using obscene or offensive usernames or aliases. Should a Player elect to do so we reserve the right to close Your Account. You can change your password at any time on “My Profile” page. The platform is designed to automatically log players out of the session after a certain period of inactivity.

1.19 All Player offers are limited to one per person, family, household address, email address, telephone number, debit/credit card and shared computer, e.g. school, public library or workplace. All CASINO TIME.ca offers are intended for recreational players and we may in our sole discretion limit the eligibility of Players to participate in any promotion. We reserve the right to withdraw the availability of any offer or all offers to any Player or group of Players.

1.20 We reserve the right to reclaim all bonuses awarded and any winnings accrued if Players are found to be tampering with or abusing any aspect of a CASINO TIME.ca promotion. Where there is evidence of a series of bets placed by a Player or group of Players, which due to enhanced payments through promotional offers results in guaranteed Player profits irrespective of the outcome, we reserve the right to ignore the bonus element of such offers and settle bets at the correct odds. We further reserve the right to ask any Player to provide sufficient documentation for us to be satisfied in our absolute discretion as to the Player’s identity prior to us crediting any bonus, free bet or offer to their account.

1.21 By registering, You are deemed to have accepted and understood all the Terms and Conditions, Privacy Statements, and other rules, regulations, limitations, and other information displayed on the Website or otherwise provided to You by CASINO TIME.ca. We recommend that all Players print out (or save to file) all transaction records, Guides, cancellation policies, and pay-out policies.

1.22 If using a credit or debit card, the Player’s name MUST be the same as the name used when registering with the Website. Where this is not the case we may suspend Your Account. If Your Account is suspended, You may contact customer support for details of our verification process at the following email address: customersupport@casinotime.ca Any withdrawals that are made by bank wire or cheque will only be payable to the name used when registering with the Website and if a debit or credit card has been used to deposit funds the name must correspond to the name registered on the card.

1.23 When updating or adding additional payment details it is Your responsibility to make Yourself aware of the terms upon which Your payments are accepted. You are solely responsible to keep informed of any changes.

1.24 We have an obligation to remit funds to players within a reasonable amount of time. Uncontested funds pending for withdrawal may be reversed back to the CASINO TIME.ca account should Players not respond or abide by the withdrawal requirements. Should withdrawals be reversed they will be available for play within CASINO TIME.ca. CASINO TIME.ca will not be held liable for funds used for gambling or playing.

1.25 All applicants may be sent an email to the registered email address for account activation. All accounts may be activated by following the instructions in this email. If this is not completed, CASINO TIME.ca reserves the right to suspend all activities on the account until the account details are verified.

1.26 No Player Account is permitted to have a negative funds balance. Further, no bet will be accepted that might result in a negative balance. If, for any reason, a Player Account reaches a balance below zero ($0.00) dollars, the account will be suspended. Aside from deposits, no transactions will be permitted until the Player Account balance is above zero ($0.00) dollars.

1.27 There may be some instances in which it may be necessary for CASINO TIME.ca to perform adjustments to Player Accounts and/or Player Account balances. In the event that such adjustments are necessary, only authorized personnel will be permitted to make those adjustments. All adjustments to Player Accounts and Player Account balances will be recorded and logged completely, clearly, and accurately by CASINO TIME.ca including, at a minimum, the specific reasons for such adjustment.

1.28 Players are not permitted to transfer funds from one Player Account to another. Any attempt to do so shall be considered a violation of this Agreement.

2. YOUR WARRANTIES

2.1 You warrant and represent, and we enter into this Agreement on the basis of and in reliance on such representations and warranties, all of which are material at the time of Your entering into this Agreement and throughout the terms hereof, that You:

  1. Are legally able to participate in online gaming at CASINO TIME.ca;
  2. Are 19 years of age or older;
  3. Shall not register for or attempt to register for multiple Player Accounts;
  4. Are not attempting to create an account as a Self-Excluded individual;
  5. Shall not allow any third party (in particular, but without limitation, any minor) to directly, or indirectly, use Your Account utilize the Software or accept a prize from CASINO TIME.ca;
  6. Are not an employee, executive officer, board member, partner of CASINO TIME.ca;
  7. Are not an employee or an executive of any trade union representing or negotiating on behalf of employees of CASINO TIME.ca;
  8. Are not an officer, board member, employee, or are otherwise affiliated with the AGCO, OLG, or iGO;
  9. Do not have access to non-public information that may impact the outcome of any game, event, or bet type;
  10. Shall immediately cease playing, betting, or otherwise accessing Your Player Account if You, at any time, are unable to comply with any requirement established in #5 through #8 herein, until such time that You are able to fully comply;
  11. Have furnished us with personal details that are valid, accurate and complete in each and every respect and that You shall advise us immediately via email should such details change;
  12. Are the true and lawful owner of the monies that You wager at CASINO TIME.ca and that You are duly and properly authorized to utilize such monies for the aforementioned purposes;
  13. Shall not deposit nor wager any monies at CASINO TIME.ca that are derived in any manner whatsoever from illegal activities outlined in Section 14 (Money Laundering) below;
  14. Are not involved in cheating or collusion;
  15. Shall pay all monies owed to CASINO TIME.ca, and in respect to any payment, shall not cause any Charge-back, or otherwise deny or reverse or countermand any such payments;
  16. Have read and understood these Terms and Conditions; and
  17. Participate at CASINO TIME.ca on an individual basis and for personal entertainment only (that is, not in a professional sense or in concert with other Players as part of a club, group, etc.).

2.2 If You breach the warranty contained in 2.1 above, all transactions placed by You shall be null and void and You shall forfeit any winnings accrued to You as a result of such transactions or participation. Your account may be restricted, suspended or closed.

3. ADDITIONAL DOCUMENTS COMPRISING PART OF THIS AGREEMENT

This Agreement incorporates by reference the terms, conditions, policies, statements and explanations of other documents, including:

  1. the applicable Pay-to-Play Game Rules;
  2. the Responsible Gambling Statement – Please Play Responsibly;
  3. the applicable Bonus Funds Terms;
  4. CASINO TIME Privacy and Cookie Policy;
  5. any applicable website user agreement; and
  6. any applicable mobile application user agreement.

In the event of any conflict or inconsistency between any provision of this Agreement and any of such other terms, conditions, policies, statements and explanations, the order of precedence shall be in descending order of clauses i. to vi. above.

4. PLAYER ACCOUNT INFORMATION

Information that is submitted by You when registering an account with CASINO TIME.ca must be true, accurate and complete at the time it is provided to CASINO TIME and such information must remain true, accurate and complete following the registration of a Player Account. You are required to attest on an annual basis, and at the time of registration, that You are verifying the information contained in Your player account is complete, accurate and up to date. You will be unable to wager or play until the annual attestation is made.

You must tell us, at the time you register and open your Account, if you are a domestic politically exposed person in Canada (“domestic PEP”), a foreign politically exposed person (“foreign PEP”), a head of an international organization (“HIO”), together with domestic and foreign PEP’s, (“PEP/HIO”), or the family member or close associate of a PEP or HIO (a “PEP/HIO Related Person”). You must also immediately tell us if your PEP/HIO or PEP/HIO Related Person status changes at any time while your account is open.

Fit to play attestation is included as Player Account information required to maintain a gaming account. You must confirm upon each login that You are “fit to play” and not under the influence of any substance that may impair Your judgement or are fatigued. If attestation is left unchecked, You will not be able to play, deposit or withdraw until the attestation of fit to play is completed.

5. PLAYER PRIVACY – YOUR CONSENT

Casino Time’s Cookie and Privacy Policy explains how we collect, use, store and disclose Your information and is hereby incorporated into this Agreement. You expressly acknowledge that You have reviewed the Cookie and Privacy Policy and agree to the practices described therein. Our Cookie and Privacy Policy can be found via a link in the footer of our website.

Consistent with our Privacy Statement and subject to the limitations therein, by registering an account, You hereby consent to us contacting You through various means of communication such as via email or SMS, in respect of matters relating to Your Account. To unsubscribe to any or all forms of communication, please contact us at customersupport@casinotime.ca.

6. PLAYER ACCOUNT

A Player can access the details of their Player Account through the CASINOTIME.ca website by going to the “My Account” page including, for example, to see the following information:

  1. the Player's registration information, including Player Contact Information.
  2. the Player's Username and Password, as well as related security questions and answers.
  3. the current notional balance of the Player Account.
  4. the financial transaction history associated with the Player Account; and
  5. the game-play history associated with the Player Account.

If a Player discovers any inaccuracy or error in the information that is contained in their Player Account, or if the Player suspects that such an inaccuracy or error may exist, regardless of who is responsible for the inaccuracy or error, the Player is required to immediately contact Customer Support customersupport@CasinoTime.ca.

Casino Time reserves the right to place a wagering limit restriction on player accounts who demonstrate a pattern of experiencing potential harm during gaming.

7. DEPOSITS INTO PLAYER ACCOUNT

7.1 Funding A Player Account

In order to play Games (other than Play-for-Free Games) on CASINOTIME.ca, a Player is required to have a positive notional balance of funds in their Player Account. All funds in a Player Account reflect CAD dollar amount as foreign exchange transactions are not permitted on the website. CASINO TIME does not accept crypto currency or Prepaid Cards. Further, CASINO TIME does not permit You to deposit Cash at our Land-Based Affiliate Sites to fund their iGaming Accounts. A Player is solely responsible for ensuring that their Player Account contains sufficient funds for a Game (including any Future Game Transaction), and CASINO TIME does not undertake any obligation or responsibility for notifying a Player if they do or may have insufficient funds available to play a particular Game prior to rejecting the relevant transaction (provided that the foregoing will not restrict CASINO TIME’s ability to so notify a Player).

In addition, subject to certain exceptions, any monetary Prizes from Games that are played through CASINOTIME.ca will be loaded to the Player Account by means of a credit to the notional balance of such Player Account. The withdrawal of funds representing such Prizes from a Player Account will be subject to the terms and conditions of this Agreement. Instructions for claiming non-monetary Prizes will be provided to Players by CASINO TIME from time to time.

7.2 Means Of Depositing Funds

A Player may fund their Player Account by depositing funds (in Canadian dollars only) with CASINO TIME by means of:

  1. an Interac Online payment from a Player’s bank account that the Player is an authorized user, as defined by the bank, to access for such purpose. When Interac Online is selected as the payment option, a Player will be redirected to the online banking website for their bank. CASINO TIME will not collect online banking login or password information.
  2. An electronic funds transfer (EFT) from a Player’s bank account that the Player is an authorized user, as defined by the bank, to access for such purpose. When EFT is selected as the payment option, a Player will be redirected to the online banking website for their bank.
  3. a Visa or MasterCard credit card issued by a financial institution which the Player is an authorized user, as defined by the financial institution, to use the Visa or MasterCard credit card for such purpose. Players should be aware that some credit card issuers may treat the funding of a Player Account as a cash advance and charge a fee for each such credit card transaction. Any cash advance fee or other fees relating to the use of a credit card are the Player’s sole responsibility.
  4. a Visa Debit card issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Visa Debit card for such purpose.
  5. a Debit Mastercard issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Debit Mastercard for such purpose.

A Player should familiarize themselves with the terms and conditions that govern the use of their chosen funding method prior to using it to fund a Player Account. Banks and financial institutions may charge a fee. Any such fees are the Player’s sole responsibility.

No other means of funding the notional balance of a Player Account is permitted as of the date of this Agreement. The merchant associated with any deposit transaction will be “Casino Time Inc.”

Each time a Player uses a credit card, Visa Debit card, Debit Mastercard, EFT, Apple/Google Pay or Interac Online, to make a deposit with CASINO TIME for purposes of funding the notional balance of a Player Account, they will be deemed to represent and warrant to CASINO TIME, that the Player has all necessary rights and authority to use such credit card or the funds in the relevant bank account, or funding account for such purposes. Rights and authority also include circumstances in which the credit card, bank account or funding account is jointly held with one or more other persons.

CASINO TIME will hold a Player's monies that are deposited with CASINO TIME for purposes of funding the notional balance of a Player Account in a bank account or escrow account as trustee for the Player (not as banker or debtor). Notwithstanding anything to the contrary contained in this Agreement, CASINO TIME will deal with a Player's money that has been deposited with CASINO TIME as a trustee, and nothing contained herein shall create or give rise to any obligation on the part of CASINO TIME to repay any money to the Player as the Player's debtor.

For the avoidance of doubt, a Player Account is not a bank account and, therefore, is not insured, guaranteed, sponsored or otherwise protected by any deposit or banking insurance system. Funds deposited with CASINO TIME for purposes of funding the notional balance of a Player Account, and monetary Prizes that are credited to a Player Account, will not accrue interest for the benefit of the Player, and the Player shall not be entitled to claim any interest from CASINO TIME in respect of any such funds.

In the event that any amount becomes owing to CASINO TIME by the Player under or in accordance with the terms of this Agreement, CASINO TIME shall have the right to deduct such amounts from the Player's Unutilized Funds and to adjust the notional balance of funds in the Player Account accordingly without the requirement for any advance or further notice to be provided to the Player by CASINO TIME.

7.3 Deposit Limits

In addition to any deposit limits established by a Player, CASINO TIME (in its sole discretion) may restrict a Player's ability to fund the notional balance of a Player Account. For example, CASINO TIME may:

7.3.1 establish minimum and maximum amounts of funds that may be deposited by a Player with CASINO TIME for the purpose of funding the notional balance of a Player Account, on a transaction-by-transaction basis or during one or more time periods.

7.3.2 limit the number of different credit cards that a Player can use to fund a Player Account (3). In addition, a particular credit card may not be registered with more than one Player Account.

7.3.3 restrict a Player's ability to change deposit methods during specified periods of time.

7.3.4 restrict a Player's ability to change certain credit card information or otherwise impose conditions prior to changing credit card information (for example, requiring that the Player contact Customer Support); or

7.3.5 change acceptable methods of payment.

Prior to a Player depositing any money with CASINO TIME for the purpose of crediting their Player Account, subject to the deposit limits set by CASINO TIME, the Player may, at their discretion, set : A maximum weekly deposit limit for their Player Account. A Player who subsequently desires to change their personal weekly deposit limit may do so subject to the following:

  1. if the Player is lowering the maximum limit, the change will have immediate effect.
  2. if the Player is increasing the maximum limit (subject to any limits prescribed by CASINO TIME in its sole discretion), the change will not become effective until a minimum cooling off period of twenty-four (24) hours has elapsed.

8. CHARGEBACKS

If a Player funds the notional balance of their Player Account and thereafter a Chargeback occurs in respect of all or part of the deposit transaction, CASINO TIME (or any of its third- party service providers) may take any or all of the following actions, in each case as CASINO TIME, in its sole discretion, determines to be appropriate:

8.1 Suspend the Player Account pending resolution of any dispute relating to the Chargeback in accordance with Section 17.1 – “Suspension of a Player Account”.

8.2 Request that the Player contact Customer Support to explain the circumstances of the Chargeback.

8.3 Debit the Unutilized Funds in the Player Account with the amount of the Chargeback. If that debit results in a negative balance of Unutilized Funds in the Player Account, the amount of the negative balance will constitute a debt owed by the Player to CASINO TIME, and CASINO TIME reserves the right to recover such amount from the Player.

8.4 Deactivate the Player Account and exclude the Player from playing Games on CASINOTIME.ca (i.e., deem the individual to thereafter be an Excluded Individual); or

8.5 initiate a dispute resolution process with the relevant bank or financial institution, which may include CASINO TIME providing evidence relating to the deposit transaction and/or Chargeback to a payment processing service provider and/or a bank or financial institution.

9. WITHDRAWALS FROM A PLAYER ACCOUNT

9.1 Methods Of Withdrawing Unutilized Funds

Subject to certain exceptions, withdrawals of Unutilized Funds from a Player Account will be processed by means of an electronic bank transfer (in Canadian dollars only) to a bank account that is registered by the Player and which CASINO TIME has verified and approved, to its satisfaction, is held by the Player at a bank or other financial institution acceptable to CASINO TIME in Canada. A Player is not permitted to designate a bank account for such purposes that is not held by the Player (alone or together with other persons). A player is not permitted to transfer funds between player accounts.

The Player acknowledges and agrees that:

  1. CASINO TIME will require the Player to submit documentation (by electronic upload via CASINOTIME.ca or as CASINO TIME may otherwise instruct) that, in CASINO TIME's sole determination, evidences the Player's authority over the bank account that is to be registered. For example, CASINO TIME may require a copy of a void cheque or a bank account statement, in either case which includes the Player's name, civic address and the bank account number, all of which must match the information associated with the Player Account that is stored in CASINO TIME's iGaming Platform.
  2. by submitting such documentation to CASINO TIME, the Player will be deemed to represent and warrant to CASINO TIME that such documentation is a true, accurate and complete copy of the original.
  3. if the Player registers a bank account that is held jointly with one or more other persons, withdrawals of Unutilized Funds from their Player Account will be paid into such joint account and, therefore, may be accessed by the other; and
  4. A Player may request a withdrawal of unutilized funds on their choice of registered payment methods authorized and setup on the Casino Time website.
9.2 Withdrawal Limits And Limitations

Subject to the terms and conditions of this Agreement, a Player may withdraw Unutilized Funds from their Player Account up to the then-current balance of Unutilized Funds. Free bets or promotional awards of any kind cannot be withdrawn.

A Player will not be entitled to withdraw Unutilized Funds from a Player Account through CASINOTIME.ca at any time that a Player Account is Suspended unless CASINO TIME, in its sole discretion, determines that the withdrawal (in whole or in part) will be permitted. If a Player Account is Suspended and the Player wants to make a withdrawal of Unutilized Funds, the Player must contact Customer Support.

CASINO TIME may from time to time specify minimum and maximum withdrawal amounts applicable to Player Accounts.

CASINO TIME may from time to time limit the number of withdrawals of Unutilized Funds by a Player that a Player can make during a specified period of time.

9.3 Withdrawal Cancellations

CASINO TIME may, in its discretion, refuse a withdrawal request if CASINO TIME suspects such withdrawal is made in breach of this Agreement (whether or not such violation is a Material Breach). CASINO TIME will make reasonable efforts to promptly notify the Player of such refusal via the Player Contact Information associated with the Player Account.

A Player may cancel their withdrawal request through their Player Account. Provided such cancellation has not been processed by CASINO TIME, the relevant funds will be returned to the Unutilized Funds in the Player Account.

9.4 Withdrawal Processing Times

Following a Player's request to withdraw Unutilized Funds from their Player Account and the satisfaction of all other terms and conditions for a withdrawal (including providing any required information or documentation to CASINO TIME), in most circumstances CASINO TIME will be able to process the withdrawal within seven (7) calendar days. In some circumstances, a longer period of time for processing a withdrawal may be required. CASINO TIME will not be required to notify the Player of any delay associated with the processing of a withdrawal of Unutilized Funds or the reason for such delay unless additional information or documentation is required to be provided by the Player.

Winnings over $10,000.00 in a single sum or aggregated within 24 hours may be subject to a review process by third parties for validation of the win. Funds may not be deposited into the player account until completion of review.

10. RESPONSIBLE GAMING

Casino Time recognizes that while gambling can be fun, it may also be addictive. As such, Casino Time has made available various tools for You to use such as setting Deposit Limits, Loss Limits, Session Limits, Reality Check. We have also made options available to You to take a break in play such as a Time Out or a longer term with our voluntary Self-Exclusion Program. Casino Time reserves the right to impose a limit on monthly player deposits in certain situations, including but not limited to when a player account is under monitoring for any reason. Casino Time may also unliterally terminate the business relationship with any player at its discretion including any time a player should be demonstrating continued RG concerns despite interventions by Casino Time.

11. BONUS FUNDS TERMS

11.1 Bonus Funds

From time-to-time CASINO TIME may, in its sole discretion, whether for promotional purposes or otherwise, offer to upload Bonus Funds into a Player Account, subject to the Player (in their discretion) accepting the offer of the Bonus Funds. Bonus Funds have a notional monetary value only, so they are not Unutilized Funds at the time they are awarded. A Player is not entitled to receive Bonus Funds unless CASINO TIME, in its sole discretion, determines that Bonus Funds should be offered to a particular Player. A Player will not be obligated to accept Bonus Funds. A Player can forfeit Bonus Funds at any time by contacting Customer Support.

CASINO TIME will have the right to determine the qualification criteria for all promotions and awarding of Bonus Funds. The criteria will be specified in the terms and conditions that CASINO TIME determines are applicable to any specific Bonus Funds, and any use of such Bonus Funds must comply with the applicable terms and conditions relating thereto (the “Bonus Funds Terms”). All Bonus Funds Terms will be deemed to be incorporated by reference in this Agreement, and in the event of any inconsistency between the Bonus Funds Terms and the terms and conditions of this Agreement, the Bonus Funds Terms shall govern to the extent of the inconsistency.

The awarding and availability of Bonus Funds are in CASINO TIME's sole discretion. The use of Bonus Funds may be limited to specific Games and specific periods of time, and Bonus Funds may expire and be cancelled if they are not used prior to a specified date or time. The applicable Bonus Funds Terms should be consulted. In addition, CASINO TIME may cancel Bonus Funds that have been uploaded into a Player Account at any time in its sole discretion.

11.2 Using Bonus Funds

If a Player who wants to play Games (other than Play-for-Free Games) has both Bonus Funds and Unutilized Funds in their Player Account (regardless of whether the awarding of the Bonus Funds preceded or followed the credit of notional funds to the balance of the Player Account, whether resulting from a deposit of funds with CASINO TIME by the Player or the winning of a Prize by the Player),the Unutilized Funds will be used first to play the eligible Games until all of the Unutilized Funds have been utilized, following which time the Bonus Funds will be used.

The Bonus Funds Terms may contemplate that certain Bonus Funds will become Unutilized Funds only after certain wagering requirements have been satisfied. A Player should review the applicable Bonus Funds Terms prior to accepting an offer of Bonus Funds. If a Player does not accept the applicable Bonus Funds Terms in their entirety, then the Player must not accept the relevant Bonus Funds or opt-out of the promotion in accordance with such Bonus Fund Terms.

All bonus offers can be redeemed only once per offer unless it is clearly stated otherwise. Each bonus offer will have its own “Bonus Funds Terms” and you should ensure that the Terms of Use associated with each individual bonus offer are read and understood prior to accepting the bonus.

In the event of an error when attributing a bonus to your account, the company reserves the right to correct such errors by removing any funds that were put into your account erroneously and by voiding any bets that were placed by these funds.

In case of bonus manipulation or abuse of any kind, we reserve the right to deduct the bonus and the winnings associated with the bonus from your account.

12. CASINO TERMS

12.1 Random Number Generator

You fully accept and agree that random number generator (“RNG”) software will determine all outcomes of Games on Casinotime.ca. including online Bingo. In the event of a discrepancy between the results displayed on your computer and a Game’s records on our server, our records shall be regarded as definitive.

12.2 Disconnection, Misuse and Malfunction

12.2.1 We, our affiliates, agents and licensors accept no responsibility and will not be liable for any loss resulting from delays or interruptions to play due to failure, breakdown, malfunction, interruption of or disconnection from the games server or any other causes over which we or they have no control.

12.2.2 Misuse, disconnection or system malfunction voids all bets, plays and pays.

12.2.3 You certify that pertaining to the services provided by us, you will not use or attempt to use any martingale betting strategy or software endowed, in our view, with artificial intelligence. Abuse of the website or services provided by us, is prohibited.

12.2.4 In the event that we reasonably determine that you used or attempted to use a product endowed with artificial intelligence in conjunction with our website or services, we reserve the right to rescind or block your account immediately, to not reimburse the amount credited to your account, and prohibit your access to all other Websites, Service and Applications offered by us.

12.2.5 In the interest of fair play, we prohibit the use of any recognized betting techniques with the aim of circumventing the standard house edge in our games. If your account shows any indication of deceptive game play through these betting techniques, your account will be suspended immediately, and we will retain any funds from the account in question.

12.2.6 Should we have any reason to believe that either an account or group of accounts are operating systemically e.g. Using specific betting techniques or group wagering, we reserve the right to permanently close all accounts. In these circumstances, we will not be under any obligation to refund you any money in your account with the exception of the amount you originally deposited, should this amount still be present.

12.2.7 If an issue is detected with a slot game, the slot game can be turned off on the back end, until further notice allowing time for full investigation and reporting to the Registrar. An auditable trail of the investigation shall be completed and kept as per the record retention policy.

12.2.9 Peer-to-peer games are not provided by Casino Time. Peer-to-peer software is not permitted and if a player is found to use such software it will be considered to be cheating and Casino Time may sanction the player accordingly.

13. EXCLUSION, DEREGISTRATION OR SUSPENSION (SEE ALSO SECTION 17)

13.1 Notwithstanding anything to the contrary contained herein, any Player Account shall be terminated on request of iGO or the Alcohol and Gaming Commission of Ontario (“AGCO”).

13.2 You have the right to deregister or terminate Your Player Account at any time. Once such election is made, Your Account will be deactivated and You will have the right to collect the remaining account balance pursuant to Section 16 “Closures of a Player Account by the Player” of this Agreement.

13.3 If You elect to Self-Exclude from Casino Time.ca:

  • You will immediately be prohibited from conducting any future gaming transaction throughout the term of Your Self-Exclusion;
  • You will be removed from Casino Time marketing lists;
  • For purposes of this section, once a player self excludes, the wager is brought to an end:
    • Casino Time shall refund a player’s wager if the player enrolls in a self-exclusion program prior to the commencement of an event or series of events on which the outcome of the wager is determined.
    • Casino Time will not refund a player’s wager if the player enrolls in a self-exclusion program after the commencement of an event or series of events on which the outcome of the wager is determined. Events also include bonus funds and entries into any promotions occurring during the self-exclusion period as the player forfeits these events with enrollment in the program.
  • During the self-excluded period, You will not be able to login to Your account and shall not attempt to create additional Player accounts.
  • You will sign a self-exclusion agreement attesting to Your understanding of the inability to login or access Your account during the specified time period. The self-exclusion agreement also details the terms and conditions of the self-exclusion program.
  • If You violate the terms of the self-exclusion agreement, You could forfeit future access to Your account.
  • You will only be allowed to return to Your account and gaming platform once the self-exclusion term ends and only by contacting Casino Time customer service.
  • 13.4 If we deregister, exclude or suspend You from the CasinoTime.ca site we shall have the right to:

    13.4.1 withhold payment to You of any contested funds whether such contested funds are deposits, refunds, bonuses, free monies, CasinoTime.ca credits, payouts or the like;

    13.4.2 determine what criteria You shall have to meet in order to establish a new Account on CasinoTime.ca; and

    13.4.3 in the case of fraudulent, illegal or similar misconduct by You or failure by You to pay any sums due to us, we have the additional rights to:

    13.4.3.1 furnish any relevant information about You and share Your Account details with a collections agency for the recovery of, any sums that You owe us as permitted by law, and You hereby irrevocably authorize us to do so in our absolute discretion; and

    13.4.3.2 retain any contested funds that may be derived by You from fraudulent, illegal or similar misconduct.

    13.4.4 If an account is removed, deactivated, or deleted for any reason, we shall retain all associated Player Information in accordance with AGCO Standard 1.09 or other records retention requirements as applicable.

    13.4.5 Any funds in the players account at the time of self-exclusion registration can be requested by the player to be withdrawn by contacting Casino Time customer service. Players may also contact the Casino Time Customer Service while in the program to request the withdrawal of funds. The requests are processed once a week. Any pre-purchased online Bingo tickets will be cancelled by Casino Time with the funds returned to the player.

    14. MONEY LAUNDERING

    14.1 There are strict laws on money laundering that may impose an obligation upon us to report You to the applicable authorities if we know, suspect or have reason to suspect that any of Your transactions, amongst other things, involve funds derived from illegal activities or are intended to conceal funds derived from illegal activities or involve the use of CasinoTime.ca to facilitate criminal activity.

    14.2 If we have knowledge or suspect that Your use of the Website or CasinoTime.ca, is illegal or otherwise improper, we may:

    14.2.1 immediately suspend, deactivate or terminate Your Account at CasinoTime.ca; and

    14.2.2 at our discretion, not to be exercised unreasonably, refuse to refund to You any funds held in such account.

    14.3 We reserve the right to report You to applicable authorities should we, in our absolute discretion, determine that we are obliged by law to do so.

    15. INACTIVE AND DORMANT ACCOUNTS

    15.1 Inactive Accounts

    A Player Account will become an Inactive Account if there has not been a successful Player-Initiated Transaction for a period of 12-consecutive months unless the Player Account is for a Self-Excluded Individual or is on the Excluded List.

    If the Future Game Transaction associated with such a Player Account expires or is suspended or cancelled for any reason, the foregoing 12- month period will be calculated beginning on the day that the last Future Game Transaction is processed from the Player Account, being the last Player-Initiated Transaction.

    A Player Account that has become an Inactive Account (no activity for 12 consecutive months) will cease to be an Inactive Account following the successful completion of a Player-Initiated Transaction.

    An Inactive Account (12 months of no player account activity) will be subject to the following monthly service fees (“Inactive Account Fees”), the amount of which CASINO TIME will be entitled to withdraw from the Unutilized Funds associated with the Player Account at the end of each month (or at any time thereafter) without the requirement for any advance or further notice to the Player.

    The monthly Inactive Account Service Fee is $5 per month (or if the balance of the Player Account is less than $5, then that balance). The monthly Inactive Service Fee will continue until the earlier of:

    • The balance of Unutilized Funds is zero; or
    • The Inactive Account becomes active; or
    • The Player requests to recover the balance of their Account.
    15.2 Dormant Accounts

    An Inactive Account will become a Dormant Account if the Player does not successfully complete a Player-Initiated Transaction within the 12-month period immediately following the date on which the Player Account becomes an Inactive Account (i.e., the Player has not successfully completed a Player-Initiated Transaction for 24 consecutive months).

    When a Player Account has become Inactive for 24 consecutive months, the Player will be contacted via contact methods on file. The player will have 30 days to respond. Should a player continue to show inactivity during those 30 days, the account will be made Dormant by CASINO TIME subsequent to the end of the 30 day notice period and subsequently Deactivated.

    Once the Player Account is Dormant (closed), the Player will not be able to log into or use the Player Account. Subject to the minimum withdrawal requirements in Section 9.2 and documentation requirements in Section 1.11, CASINO TIME will deposit an amount equal to the Unutilized Funds as at such date into the bank account that is associated with the Player Account, the details of which are stored by CASINO TIME on the iGaming Platform. In the event that no bank account is associated with the Player Account, or if CASINO TIME is not able to successfully deposit the Unutilized Funds in such bank account (for example, because the bank account has been closed or because CASINO TIME requires additional information in order to confirm that the bank account belongs to the Player), CASINO TIME will use its reasonable efforts to contact the Player using the Player Contact Information on file to advise as to the status of the Player Account and the balance of Unutilized Funds. If CASINO TIME is unable to contact the player within three (3) months of the Player Account becoming a Dormant Account, the remaining balance of Unutilized Funds may be forfeited to CASINO TIME.

    15.3 Reactivation Of A Dormant Player Account

    CASINO TIME will retain information relating to a Dormant Account in the iGaming Platform in accordance with its record retention policies. If a Player wishes to reactivate the Dormant Account, they are required to contact Customer Support. The Player may be required to take additional steps to verify their identity in order to complete the reactivation process.

    Once the Account is reactivated, it will have the same account details as those which existed as of the date the Player Account became a Dormant Account. In the event that any of the relevant information has changed (for example, the Player Contact Information), the Player will be solely responsible for updating such information and complying with the terms and conditions of this Agreement which are then in effect.

    16. CLOSURES OF A PLAYER ACCOUNT BY THE PLAYER

    A Player may close their Player Account at any time through the "My Account” – “Account Closure” – “Close Account” section of their profile or by contacting Customer Support. If a Player is no longer eligible to have a Player Account (for example, if the Player will be relocating to a jurisdiction outside of the Province of Ontario, or if the Player becomes an Excluded Individual), the Player is required to Close their Player Account.

    Player Self Closure
    The player must either withdraw all remaining unutilized funds prior to commencing account closure, subject to the minimum withdrawal requirements in Section 9.2 or play their account balance to zero and then commence account closure process.

    Player contacts customer support to close account
    When a player contacts customer support, the support center agent will encourage the player to withdraw remaining unutilized funds to zero, prior to commencing account closure, subject to the minimum withdrawal requirements in Section 9.2. If the unutilized funds balance is below the minimum withdrawal requirement ($10 CAD) the agent will make an administrative adjustment to the account equal to the remaining balance forcing the account to a zero balance. Customer Service will then complete the account closure process.

    Notwithstanding the Closure of the account, CASINO TIME will retain a Player’s information in accordance with its record retention policies.     Upon Closure of a Player Account the Player Account will no longer be accessible by the Player. All Future Game Transactions associated with the Closed Player Account that have not been completed by the time of Closure will be cancelled. The account will remain closed for a minimum of 30 days after which the Player can contact Customer Support to request re-opening. Casino Time will review the request to determine if the account can be reopened. If approved Casino Time will contact the Player advising the account has been reopened as requested.

    17. DEACTIVATION OR SUSPENSION OF A PLAYER ACCOUNT IN CASINO TIME'S DISCRETION

    17.1 Suspension Of A Player Account

    CASINO TIME shall have the right to suspend a Player Account at any time in its sole discretion (a “Suspended Account”). Without limiting the foregoing, and by way of example only, CASINO TIME may Suspend a Player’s access to their Player Account if it suspects that the Player has improperly initiated a Chargeback or has committed any breach of this Player Agreement, applicable law, Game Rules, and/or the Pay- to-Play Game Rules. While a Player Account is Suspended:

    17.1.1 A Player will be unable to access their Player Account.

    17.1.2 A Player will be unable to withdraw any Unutilized Funds unless they contact CASINO TIME customer service.

    17.1.3 All Future Game Transactions associated with the Suspended Player Account will be suspended and/or cancelled (i.e., no purchase or other financial transaction in respect thereof that has not been completed at the time the Player Account is Suspended will be completed); and

    17.1.4 A Player may be required to cooperate with any investigations conducted by CASINO TIME into the Player’s conduct prior to the Suspension being lifted (including provisions of additional documentation or information as requested by CASINO TIME). Failure to cooperate with this subsection shall be deemed a Material Breach of this Agreement.

    If, during the Suspension, CASINO TIME determines that the Player has committed a Material Breach of this Agreement, it may Deactivate the Player Account in accordance with Section 17.2.

    17.2 Deactivation Of Player Accounts

    CASINO TIME shall have the right to deactivate a Player Account at any time in its sole discretion (a “Deactivated Account”).

    If CASINO TIME Deactivates a Player Account, a Player will be unable to login or access their Player Account. CASINO TIME will deposit an amount equal to the Unutilized Funds as at such date into the bank account that is associated with the Player Account (subject to the minimum withdrawal requirements detailed in Section 9.2 and additional documentation requirements in Section 1), the details of which are stored by CASINO TIME on the iGaming Platform. In the event that no bank account is associated with the Player Account, or if CASINO TIME is not able to successfully deposit the Unutilized Funds in such bank account (for example, because the bank account has been closed or because CASINO TIME requires additional information in order to confirm that the bank account belongs to the Player), CASINO TIME will use its reasonable efforts to contact the Player using the Player Contact Information. If CASINO TIME is unable to contact the Player, then CASINO TIME will retain the Unutilized Funds until CASINO TIME receives proper instructions relating to the disposition of such funds from the Player or their legal representative.

    Notwithstanding the foregoing, if CASINO TIME Deactivates a Player Account as a result of the occurrence of a Material Breach by the Player under this Agreement, CASINO TIME (in its sole discretion) shall be entitled to treat any or all of the Unutilized Funds as forfeited by the Player, in which case the Player will not be entitled to have the Unutilized Funds returned.

    17.3 Effect Of Deactivation Or Closure Of A Player Account

    Without limiting the foregoing, when a Player Account is a Closed Account or a Deactivated Account:

    1. Any scheduled wagers, bets or purchases (including for Future Game Transactions) that have not been completed prior to the Closure or Deactivation will be cancelled.
    2. the Player will not be entitled to receive any offers for new Bonus Funds, and any existing Bonus Funds associated with the Player Account will be cancelled and the Player will not be entitled to receive any compensation in respect of the cancelled Bonus Funds; and
    3. this Agreement will terminate, except for those provisions which by their nature are intended to survive the termination of this Agreement.

    18. ACCESSING AND USING CASINOTIME.CA

    18.1 Supply And Maintenance Of Player Equipment And Services

    You are solely responsible for supplying and maintaining all equipment, technology and services that they require to access and use CASINOTIME.ca. The performance or operation of CASINOTIME.ca or any website or Mobile Applications that CASINO TIME may make available to Players from time to time may be affected by a Player's computer equipment, mobile device, Internet connection or other factors that are outside of CASINO TIME's control. In some cases, You may not be able to access or use some or all the components or functionality of CASINOTIME.ca as a result of deficiencies in their own equipment or technology or the service providers retained by them. For example, a slow Internet connection could adversely impact the performance or operation of CASINOTIME.ca, or an outdated web browser or the settings on a Player's computer could cause some or all the content of CASINOTIME.ca to display incorrectly or to fail to display.

    CASINO TIME makes no representation or warranty of any kind regarding the compatibility, functionality, performance or operation of CASINOTIME.ca or any component thereof on any of Your computer or other devices used to access CASINOTIME.ca.

    CASINO TIME makes no representation or warranty of any kind regarding the compatibility, functionality, performance or operation of CASINOTIME.ca or any component thereof on any device used at a land-based gaming affiliate site of CASINOTIME.ca. Affiliate sites own and maintain their own devices and provide their own internet connection service providers to access CASINOTIME.ca. Affiliate sites are not owned, operated or controlled by CasinoTime.ca. Players may require additional third-party services to access CASINOTIME.ca (e.g., internet service provider agreement; mobile carrier agreement; email account; text messaging service (SMS)). The Player is solely accountable for any agreements and charges related to these third-party services. A Player should familiarize themselves with the terms and conditions that govern any such services prior to using them to access CASINOTIME.ca.

    18.2 Third-Party Content; Joint Games

    To access or use certain components of CASINO TIME.ca, it may be necessary for You to download software (for example, certain casino games may require a flash player or an up-to-date web browser.)

    Certain third-party product providers may require You to accept and agree to additional terms and conditions governing the use of their products. It is the sole responsibility of You to determine whether they accept and agree to any such third-party terms and conditions, and if You do not accept and agree to them, such third-party product should not be used.

    CASINO TIME shall not be liable for any direct or indirect damage to, or loss of data from, Your equipment that may arise from or as a result of the access or use of CASINOTIME.ca or any content, software or applications made available by or on behalf of CASINO TIME through CASINO TIME.ca.

    Some Pay-to-Play Games may be offered jointly and networked with multiple provincial iGaming jurisdictions. Players playing such Games could face opponents from within Ontario as well as opponents located elsewhere in Canada subject to applicable AGCO Standards and iGO Policies.

    19. CASINO TIME'S INTELLECTUAL PROPERTY RIGHTS

    CASINO TIME is the owner or licensee of all of the copyright, trademarks, domain names, design rights, database rights and all other intellectual property rights in, to and in respect of CASINOTIME.ca and the iGaming Platform, including the content of the foregoing, the Games and any written communications that are sent to You by or on behalf of CASINO TIME (collectively, “CASINO TIME IP Rights”). You shall not be deemed to be granted or to receive any rights in or to any of the CASINO TIME IP Rights except to the extent specifically contemplated in, and subject to the terms and conditions of, this Agreement.

    20. VIRUSES, HACKING AND OTHER OFFENCES

    The access or use of CASINOTIME.ca other than in accordance with the terms and conditions of this Agreement is strictly prohibited. You shall not:

    20.1 knowingly or negligently introduce, or permit the introduction of, any virus, trojan, worm, logic bomb or other material that is or would reasonably be expected to be malicious or technologically harmful to CASINOTIME.ca, the iGaming Platform, any Game or any component of any of the foregoing.

    20.2 access or attempt to gain access to CASINOTIME.ca, the iGaming Platform, any Game or any component of any of the foregoing that they are not entitled to access, including the servers on which CASINOTIME.ca, the iGaming Platform or any Game is stored, or any server, computer or database connected to CASINOTIME.ca, the iGaming Platform or any Game. The foregoing restriction includes any attempt to bypass any security mechanisms included in CASINOTIME.ca, the iGaming Platform or any Game, including those which are intended to protect the security of Player's personal information:

    1. use any software program which, in CASINO TIME's sole determination, is endowed with artificial intelligence (i.e., robots) in connection with the Player's participation in a Game.
    2. attack, whether alone or in combination with others, CASINOTIME.ca by means of a denial-of-service attack or a distributed denial-of-service attack.
    3. translate, reverse engineer, decompile, disassemble, modify, create derivative works based on, or otherwise modify or make any attempt to discover the source code of any software (or any part thereof) that is downloaded through or in connection with the access or use of CASINOTIME.ca.
    4. copy, disclose (including, for example, by posting on any social media, blog, message board or other public forum), transmit or otherwise make available, or remove or alter, any of the content or material that is made available on or through CASINOTIME.ca; or
    5. remove, obscure or alter any notice of any CASINO TIME IP Right (including any designation of copyright or trademark) contained in any content or material that is made available on or through CASINOTIME.ca.

    20.3 A failure to comply with this Section will constitute a material breach of this Agreement by You and CASINO TIME (in its sole discretion) may choose to Deactivate or Terminate Your Player Account – Section 17 or 22, respectively.

    21. COLLUSION, CHEATING, FRAUD AND CRIMINAL ACTIVITY

    Each Player is prohibited from engaging in, and is required to immediately notify CASINO TIME if they aware that another Player is or may be engaging in, any form of collusion, cheating, fraud or criminal activity or otherwise exploiting an unfair advantage involving any Game or other component of CASINOTIME.ca, including in connection with the registration of a Player Account, the deposit of funds with CASINO TIME to the credit of the notional balance of a Player Account, making a bet, wager or purchase of a Game, or the withdrawal of Unutilized Funds.

    21.1 For the purposes of this Agreement, as examples only:
    1. fraud includes the unauthorized use of a credit card as a source of funds to be deposited to the credit of a Player Account.
    2. criminal activity includes money laundering.
    3. an unfair advantage includes the use of any software that could provide a Player with an unfair advantage (including, by way of example only, “bots”, artificial intelligence, machine learning software, malicious code, opponent profiling software, automatic betting software, viruses, worms, or malware); and
    4. an unfair advantage includes the exploitation of a fault, loophole or error in any software that is used in connection with the operation of CASINOTIME.ca (including any Game) or the exploitation of any Error.

    21.2 CASINO TIME will use reasonable efforts to detect and prevent any such collusion, cheating, fraud or criminal activity by Players or the taking of any unfair advantage by Players, but in the event that any such activity occurs and another Player incurs any loss or damage, CASINO TIME will not be liable for any such loss or damage.

    21.3 CASINO TIME shall have the right to notify all third parties which CASINO TIME, in its sole discretion, determines to be appropriate in the event of any actual or suspected collusion, cheating, fraud or criminal activity by any Player or the taking of any unfair advantage by any Player, including the appropriate law enforcement authorities and other third parties that CASINO TIME determines to be appropriate (for example, police services, the AGCO, CASINO TIME's payment processors, Event governing bodies, other operators/providers of sports being platforms, and credit card issuers and brands).

    22. TERMINATION OF ACCOUNT

    We reserve the right to cancel Your Account for any reason whatsoever at any time without notice to You. Any balance in Your Account at the time of such cancellation will be addressed as stated under Section 17 – “Deactivation of Player Accounts”. However, we reserve the right, in our discretion, not to be exercised unreasonably, to void any winnings and confiscate any balance in an account in any of the following circumstances:

    • if You have more than one active Account;
    • if the name on Your Account does not match the name on the credit card(s) used to make deposits on an Account;
    • if You participate in a promotion and cash-in before fulfilling the requirements of that particular promotion;
    • if You provide incorrect or misleading registration information;
    • if You are not of legal age;
    • if You reside in a jurisdiction where participation in CasinoTime.ca games are prohibited by law;
    • if You have allowed or permitted (intentionally or unintentionally) someone else to play on Your Account;
    • if You have not played at CasinoTime.ca on an individual basis for personal entertainment only (that is, You have played in a professional sense or in concert with other Player(s) as part of a club, group, etc.);
    • if we receive Charge-backs or returns via a deposit mechanism used on Your Account;
    • if You are found colluding, cheating, match-fixing, money laundering, or otherwise undertaking fraudulent or illegal gaming activity;
    • if it is determined by us that You have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the CasinoTime.ca site;
    • if You use CasinoTime.ca, Website, or Your Account in bad faith;
    • if You, as part of uploading Your Content to the Services, including the CasinoTime.ca or Mobile Casino:
    • upload, post, email or otherwise transmit any of Your Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise unlawful or objectionable (including, without limitation, nudity and depiction of drug use);
    • harm minors in any way;
    • impersonate any person or entity, including but not limited to a representative of a Casino Time Party, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
    • forge headers or otherwise manipulate identifiers in order to disguise the origin of any of Your Content transmitted through the Services;
    • upload, post, email or otherwise transmit any of Your Content that You do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information or proprietary and confidential
    • information learned or disclosed as part of employment relationships or under nondisclosure agreements);
    • upload, post, email or otherwise transmit any of Your Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
    • upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas that are designated for such purpose;
    • upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, emulate, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    • disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Services are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;
    • interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
    • “stalk” or otherwise harass another person or user;
    • collect or store personal information or data about other Services users, or disclose another user’s personal information or data to any third party;
    • solicit personal information or data from anyone under 19 years of age; or
    • use any “bot,” “hack,” “crack,” or otherwise attempt to circumvent any access control, copyright protection or license-enforcement mechanisms associated with or related to the Services.
    • If we become aware that You have played at any other CasinoTime.ca under any of the circumstances set out above.

    23. ERRORS AND UNAVAILABILITY OF CASINOTIME.CA

    23.1 Casino Time's Errors

    A number of circumstances may arise where a Game-related wager or purchase is accepted by CASINO TIME, or where CASINO TIME awards a Prize, credits a Player Account or processes a withdrawal, in each case in error (an “Error”). As examples only, Errors may include:

    1. where CASINO TIME misstates any Pay-to-Play Game Rules or Bonus Funds Terms, in each case as a result of an obvious error or omission in inputting the information, or as a result of a computer malfunction;
    2. where CASINO TIME credits a Player Account, thereby increasing the amount of Unutilized Funds, as a result of a manual or computer input error; or
    3. where CASINO TIME deposits into a Player's bank account an amount that is greater than the amount of Unutilized Funds in a Player Account.

    23.1.2 CASINO TIME reserves the right to correct any Error in the manner that it deems appropriate in the circumstances, and CASINO TIME's decision shall be final and binding.

    23.1.3 Neither CASINO TIME nor any of its employees, agents or service providers shall be liable for any loss incurred by a Player that results from any Error, including any loss of winnings that results from a forfeiture thereof by the Player as a result of the Error. CASINO TIME shall use reasonable efforts to notify a Player if any Error has adversely impacted the Player, or if the correction of any Error adversely impacts the Player.

    23.1.4 In the event that CASINO TIME pays any money (i.e., by processing a withdrawal) to a Player as a result of or in relation to an Error, the Player shall be deemed to hold such money in trust for CASINO TIME, and CASINO TIME shall have the right to recover such money through a correcting entry to the extent that funds are available in the Player’s Player Account and, if sufficient funds are not available, through a demand for payment to that person which demand the person shall immediately satisfy, to the extent of any deficiency, in accordance with CASINO TIME's reasonable instructions.

    23.1.5 If an Error results in a credit to a Player Account (the amount of such credit being “Error Funds”), any subsequent Game-related bet, wager or purchase may be deemed by CASINO TIME to have been made using the Error Funds, and (i) CASINO TIME may cancel such bet, wager or purchase, and (ii) if any Prize in respect thereof has been credited to the Player Account or otherwise paid or delivered to the Player, the Player shall be deemed to be holding the full amount of such Prize in trust for CASINO TIME, and (iii) upon CASINO TIME making a demand for the return of such Prize, the Player shall immediately return the Prize to CASINO TIME in accordance with CASINO TIME's reasonable instructions.

    23.2 Unavailability Of Casinotime.Ca

    CASINO TIME may temporarily suspend the whole or any part of CASINO TIME.ca or any game or activity for any reason at our sole discretion. CASINO TIME may, but shall not be obliged to, give You as much notice as is reasonably practicable of such suspension.

    Notwithstanding anything to the contrary contained in this Agreement, a Player shall not be entitled to any compensation arising from or as a result of any Downtime including, for example, if a Player is unable to withdraw Unutilized Funds through CASINOTIME.ca or if Bonus Funds expire during the period of any Downtime.

    If a game cannot be continued after a service interruption, players will either be paid the amount won up to that point or bets returned - whichever is the better outcome for the player.

    In the situation where a customer may be negatively affected by feed provider errors, Casino Time will make the proper remedial actions on a timely basis.

    24. DISPUTES

    No claim or dispute by a Player with regard to any wager or purchase of a Game, including the outcome of such Game, will be considered by CASINO TIME if initiated more than 30 days following the date on which the Game is completed.

    CASINO TIME's records, as maintained in the iGaming Platform (and/or CASINO TIME's central computer-controlled online system, in the case of a Draw-Based Lottery Game Played Online), will be the final authority in determining the circumstances of a Player's participation in the relevant Game and the results of such participation. In the event of a disagreement between the result that appears on a Player's screen and the relevant Game servers, the result that appears in the Game servers will prevail.

    If You wish to make a complaint about CASINO TIME or any aspect of CASINOTIME.ca, You may do so by contacting Customer Support or otherwise contacting CASINO TIME in accordance with Section 27.1. You may also contact the AGCO (CASINO TIME's regulator) using the contact information in Section 27.2.

    25. INDEMNITY AND LIMITATIONS OF LIABILITY

    You agree that You are free to choose whether to participate in CasinoTime.ca at CASINO TIME.ca, access and use the Websites and use the Services offered by CASINO TIME and do so at Your sole option, discretion and risk.

    You will indemnify and hold harmless us and our directors, officers, employees, shareholders, subcontractors, agents and affiliates against any and all costs, expenses, liabilities and damages (whether direct, indirect, special, consequential, exemplary or punitive or other) arising from any participation by You at CASINO TIME.ca.

    Except as otherwise provided in the applicable Pay-to-Play Game Rules, CASINO TIME's (including, but not limited to the extent applicable, , CASINO TIME’s service providers, subcontractors, employees, agents, and assigns) maximum liability, subject always to Section 20.2 to You under this Agreement or otherwise in respect of the accessing or use of CASINOTIME.ca shall not exceed the lowest of:

    1. the dollar amount value of the wagers, purchases or tips actually made by a Player via their Player Account in respect of the relevant wager, purchase, tip or Game that gave rise to the relevant alleged liability; or
    2. the amount of applicable monies, where such monies have been improperly directed by CASINO TIME or misplaced by CASINO TIME; or
    3. an aggregate of $500 in respect of all other liabilities, including for liabilities resulting from or as a result of any negligent act or omission of or by CASINO TIME or any of CASINO TIME's service providers, or anyone acting on behalf of CASINO TIME or any of CASINO TIME's service providers.
    25.1 Exclusions From Casino Time's Liability

    Notwithstanding anything to the contrary contained in this Agreement, CASINO TIME shall not be liable for any loss or damage suffered by any person as a result of:

    1. the operation of CASINOTIME.ca, the iGaming Platform;
    2. the failure of CASINOTIME.ca, the iGaming Platform to operate properly or at all;
    3. the participation by any person in, or any failure, negligence or wrongdoing by CASINO TIME or any of CASINO TIME’s service providers in respect of, any responsible gambling program operated by CASINO TIME or any of CASINO TIME’s service providers, including: (i) the self-exclusion program; (ii) player breaks; (iii) deposit limits; (iv) spend limits; (v) playing time reminders; (vi) self-assessment tools; (vii) risk profiles;
    4. the failure of CASINO TIME or any of CASINO TIME’s service providers to: (i) process or record a purchase; (ii) display an accurate purchase confirmation in such person’s player account; or (iii) otherwise complete a transaction (including, without limitation, a Future Game Transaction);
    5. or any wager or tip erroneously or unintentionally made by a Player.

    25.2 For greater certainty, You shall not have the right to claim damages under or in connection with CASINOTIME.ca or this Agreement or for breach of this Agreement by CASINO TIME, in tort, in contract or on any basis whatsoever to the extent that any loss claimed by You is:

    1. for punitive, exemplary or aggravated damages; or
    2. for loss of profits, loss of chance, loss of use, loss of production, loss of business or loss of business opportunity, including (but not limited to) loss of data, profits, revenue, goodwill, reputation or business interruption; or
    3. a claim for consequential loss or for indirect loss of any nature suffered or allegedly suffered by You; or
    4. not reasonably foreseeable by CASINO TIME arising out of this Agreement or the use of CASINOTIME.ca.

    CASINO TIME does not make any other promise, representation or warranty regarding CASINOTIME.ca or any of the Games or other products or services that are made available on or through CASINOTIME.ca, and except as specifically included in this Agreement, CASINO TIME hereby disclaims all warranties regarding the foregoing, whether express, implied or statutory, including all implied warranties in respect of the same.

    You acknowledge and agree that, by accepting the terms and conditions of this Agreement, they do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding of any person, other than those of CASINO TIME which are included in (or expressly incorporated by reference into) this Agreement.

    26. ADVERTISING

    26.1 Publishing Winner Information

    If You win a sum of money or any other prize regarded by CASINO TIME as being worthy of publicity, You agree to make Yourself available for any event to publicize Your win arranged by the CASINO TIME.ca. CASINO TIME .ca will make reasonable efforts to protect Your privacy as part of such events. Further, You grant CASINO TIME the right to use Your first name in any publicity about Your win, along with the prize amount and town/city (as mentioned in this paragraph) and to use a picture of a model of CASINO TIME’s choice to represent You in any published materials.

    DEFINITIONS

    • “AGCO Standards” means the Registrar’s Standards for Internet Gaming, as amended or replaced from time to time.
    • “Agreement” means these Terms and Conditions – Terms and Conditions of use for CASINO TIME.ca, as amended or replaced from time to time by CASINO TIME.
    • “Bonus Funds” means a notional amount corresponding to Canadian dollars that is loaded into a Player Account by CASINO TIME. Bonus Funds, subject to the applicable Bonus Funds Terms, can be used by a Player to play Pay-to-Play Games or Draw-Based Lottery Games Played Online including iBingo, or both, without charge to the Player.
    • “Bonus Funds Terms” means a notional amount corresponding to Canadian dollars that is loaded into a Player Account by CASINO TIME. Bonus Funds, subject to the applicable Bonus Funds Terms, can be used by a Player to play Pay-to-Play Games or Draw-Based Lottery Games Played Online including iBingo, or both, without charge to the Player.
    • “CASINO TIME” means Casino Time Inc. and the successors thereof.
    • “CASINO TIME.ca” means CASINO TIME's website and Mobile Applications through which select Games are made available to eligible Players from time to time.
    • “CASINO TIME Privacy and Cookie Policy” means the CASINOTIME.ca’s privacy and cookie policy, as amended or replaced by CASINO TIME from time to time.
    • “CASINO TIME IP Rights” means all intellectual property rights, including without limitation all Content and material supplied as part of the CasinoTime.ca website and the Software.
    • “Chargeback” means when a Player, a credit card issuing bank, or any other third-party payment solutions provider effects a reversal of charges in relation to the Player’s credit card or third-party deposit transaction.
    • “Closed Account” means a Player Account that has been closed by the Player.
    • “Close” or “Closure” means the act of a Player closing their Player Account as described in Section 12.4.
    • “Customer Support” means CASINOTIME.ca's customer support services.
    • “Deactivate” or “Deactivation” or “Deactivated Account” means that a Player Account has been set to a Deactivated Account status by CASINO TIME due to a Material Breach of this agreement.
    • “Dormant Account” means a Player Account that has not had a successfully completed Player-initiated Transaction for 24 consecutive months but does not include the Player Account of a Self-Excluded Individual or an Excluded Individual.
    • “Downtime” means when access to Casino Time.ca is limited or not available due to conducting software maintenance, upgrades or addressing issues.
    • “Event” has the meaning specified in the applicable Pay-To-Play Game Rules.
    • “Error Funds” has the meaning specified in Section 21. 
    • “Event” has the meaning specified in the applicable Pay-To-Play Game Rules. 
    • “Excluded Individual” means an individual who is not permitted to register an account or maintain an Account with CASINO TIME.ca.
    • “Financial Activity” is defined by the placing of bets anywhere on this website (voided/cancelled bets do not count).
    • “FINTRAC” means the Financial Transactions and Reports Analysis Centre of Canada and the successors thereof.
    • “Games” means, collectively Pay-to-Play Games and Play-for-Free Games.
    • “Gaming Day” means a day of the week commencing at 12:00:00 AM and ending at 11:59:59 PM.
    • “iGaming Platform” means the system that is used by CASINO TIME for the purpose of registering and administering Player Accounts, facilitating the playing of Games by Players, and paying Prizes.
    • “iGo” means iGaming Ontario and the successors thereof.
    • “iGo Policies” means the iGO Policies, standards, Guidance documents and requirements contained in the iGO Operating Agreement with Operators for iGaming in Ontario, as amended or replaced from time to time.
    • “Inactive Account” means a Player Account that has not recorded any Player-Initiated Transaction for a period of twelve (12) consecutive months. This does not include accounts that are participating in the Self-Exclusion program nor those who have been Excluded from the Site for other reasons.
    • “including” is deemed to mean “including without limitation” and shall not be deemed limited by the specific items listed.
    • “Mobile Applications” means any application developed by or on behalf of CASINO TIME that You can install on Your mobile device, such as mobile phone or tablet, and through which select Games are made available to You from time to time.
    • “Online Bingo” means Pay to Play Bingo accessed via the Casino Time website;
    • “Payment Service Provider” means a third party with whom we have an arrangement to process payment transactions;
    • “Pay-to-Play Game means any of the games made available through CASINOTIME.ca from time to time that: (i) constitutes a “lottery scheme” for purposes of the Criminal Code (Canada), (ii) requires the Player to place a bet or make a wager as a condition to entering the game, and (iii) affords the Player a chance to win a Prize but does not include any Draw-Based Lottery Game Played Online or any Play-for-Free Game. Examples of Pay-to-Play Games include Casino style games such as roulette and slots.
    • “Pay-to-Play Game Rules” means the terms, conditions, explanations, rules and procedures (for example, how a Prize is won, the value and odds of winning Prizes for an individual Pay-to-Play Game, the Prize tiers within a Pay-to-Play Game) issued by CASINO TIME from time to time (in addition to this Agreement) which apply to a particular Pay-to-Play Game and which are designated by CASINO TIME as Pay-to-Play Game Rules. Subject to Section 3, the Pay-to-Play Game Rules are incorporated into and form part of this Agreement.
    • “Player” means an individual who has successfully registered a Player Account and includes Excluded Players, Dormant Player, Inactive Players or a Closed Account Player.
    • “Player Account” means a Player's account of notional funds corresponding to Canadian dollars that is maintained on the iGaming Platform, and also includes the Player's registration information, deposit and withdrawal transaction history, and game-play information that the Player can access through CasinoTime.ca.
    • “Player Contact Information” means a Player's contact information that is associated with a Player Account and stored in the iGaming Platform at the relevant time including, for example, the Player's name, e-mail address, mailing address and telephone number.
    • “Play-for-Free Game” means any of the free games made available through CASINOTIME.ca from time to time that contain some of the features of a “lottery scheme” for purposes of the Criminal Code (Canada) but do not afford a chance to win a Prize or require any payment to play.
    • “Player Initiated Transaction” means:
      1. a deposit of funds by the Player for the purpose of funding the Player Account;
      2. a withdrawal of Unutilized Funds from the Player Account; or
      3. a purchase for Pay-to-Play Game, including a Future Game Transaction that has not expired or been suspended due to insufficiency of Unutilized Funds or for any other reason.
      For the avoidance of doubt, a Play-for-Free Game is not considered a Player-Initiated Transaction.
    • “Service” or “Services” means the availability and provision of Software that enables You to play at CASINO TIME.ca or Mobile Casino using the Internet in connection with Your use of the mobile applications, online and mobile games, being prescribed online lottery schemes iGaming Ontario is authorized to conduct and manage, Your participation in promotions and giveaways that may be sponsored by either us or third party companies, Your interactions with the server software, web technologies and branded websites used to provide any of the above and any communications You may have related thereto and any other related services;
    • “Self-Excluded Individual” is an individual who is actively enrolled in the Self-Exclusion Program;
    • “Self-Exclusion” means the program and associated processes through which Player’s voluntarily elect to exclude themselves from gaming sites for a prescribed period of time.
    • “Software” means any software owned or licensed that must be downloaded or otherwise used in order for You to participate at CASINO TIME.ca;
    • “Suspend”, “Suspension” or “Suspended Account” means a Player Account that has been set to a Suspended Status by Casino Time for further investigation purposes.
    • “Unutilized Funds” means any notional funds corresponding to Canadian dollars that are credited to a Player Account, including Prizes but excluding Bonus Funds, that have not been used by the Player.
    • “Username and Password” means a unique combination of identifiers created You that is used by You to identify yourself to the iGaming Platform each time You access Your Player Account.
    • “We”, “us” or “our” means Casino Time Inc., which is the owner and operator of CASINO TIME.ca.
    • “Week” means the seven-day period commencing on Monday at 12:00:00 AM and ending on Sunday at 11:59:59 PM.
    • “You” or “Your” means any person who seeks to access or use CASINO TIME.ca.

    1. YOUR PARTICIPATION AT CASINO TIME.ca

    This document contains the terms and conditions that govern the use of the CasinoTime.ca online gaming platform. By checking the “accept” box, You are confirming You understand and agree to be bound by the terms and conditions of this Agreement. If You do not agree with any of the terms and conditions, You:

    1. are not permitted to register an account with CasinoTime.ca, and
    2. if You already have a Player Account , You are not permitted to log into Your Player Account and play any Games on CasinoTime.ca.

    1.2 CASINO TIME reserves the right to revise this Agreement from time to time in such manner as CASINO TIME, in its sole discretion, determines to be appropriate. CASINO TIME will post a notice on CASINOTIME.ca advising You when this Agreement has been revised and prior to logging into Your Player Account, You will be required to acknowledge and agree to be bound by the revised terms and conditions from and after that date. You are responsible for familiarizing yourself with all terms and conditions of this Agreement and ensuring that You understand and agree to be bound by them prior to registering an account with CASINOTIME.ca or logging-in to Your Player Account.

    1.3 If You breach or otherwise fail to comply with the terms and conditions of this Agreement, CASINO TIME will have the right to exercise any or all remedies described in this Agreement or otherwise available to it at law or in equity. Those remedies may include, for example,

    1. the right to terminate Your Player Account,
    2. to lock, Suspend, and/or Deactivate Your Player Account, and
    3. to retain any or all Unutilized Funds associated with Your Player Account.

    1.4 This agreement shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada.

    1.5 Each provision of this agreement shall be valid and enforceable to the fullest extent permitted by law. If any provision of this agreement is declared invalid, unenforceable, or illegal by a court of competent jurisdiction, such provision may be severed and such invalidity, unenforceability or illegality shall not prejudice or affect the validity. enforceability and legality of the remaining provisions of this agreement.

    1.6 Participation at CASINO TIME.ca, access and use of the Website and use of Services offered by us is at Your sole option, discretion and risk.

    1.7 Internet Gambling may be illegal in Your Jurisdiction. CASINO TIME.ca is not intended to enable You to contravene applicable law and is only to be used if You are 19+ and located in the Province of Ontario.

    1.8 CASINO TIME.ca cannot process bets for individuals residing outside of the Province of Ontario.

    The following individuals are not eligible to participate at CASINO TIME.ca or to otherwise use the Services, and by registering You acknowledge and confirm that each of the following categories does not apply to You:

    1. An individual who is physically situated outside the Province of Ontario;
    2. individual under 19 years of age. We reserve the right to ask for Your proof of age and suspend Your Account until satisfactory documentation is provided;
    3. An individual that is participating in a self-exclusion process that applies to the Website;
    4. An individual who has been restricted from accessing the Website or playing a lottery scheme as a condition of a court order;
    5. An individual has been excluded from the Website under subsection 3.6(1) of the Gaming Control Act, 1992;
    6. Officers, members of the board of directors, or partners of Casino Time Inc.;
    7. Executives or staff of a trade union who represent or negotiate on behalf of employees employed by Casino Time.ca;
    8. Employees of registered suppliers who maintain or repair gaming equipment for the Website; and
    9. Members or employees of the Alcohol and Gaming Commission of Ontario, and officers, members of the board of directors, or employees of Ontario Lottery and Gaming Corporation or iGO, unless they are within the description set out in subsection 22(6) of Ontario Regulation 78/12.

    1.9 Individuals described above in Paragraph 1.8 are not eligible for prizes with the exception of self-excluded individuals.

    1.10 We do not warrant the legality of Your participation at CASINO TIME.ca in terms of the laws of Your Jurisdiction.

    1.11 We have the right to request that You furnish us with proof of Your identity and age as a condition precedent to us allowing You to participate at CASINO TIME.ca. Additional personal information requested at time of Registration includes Your Full Name, Date of Birth, Telephone Number, email Address, Descriptive Occupation, Citizenship, Country of Residence. All information supplied when registering with the Website or otherwise required to access CASINO TIME.ca must be accurate and complete in all respects.

    1.12 You hereby authorize us and our designated agents as and when we require, to confirm Your identity and Your right to use the monies that You wager at CASINO TIME.ca.

    1.13 You may not open and maintain more than one account at any point in time.

    1.14 CASINO TIME.ca, at its discretion, reserves the right to pay any winnings in Canadian Dollars, to require any and all bets or plays to be in Canadian Dollars, to facilitate all purchases using Canadian Dollars, and to require all withdrawals to be in Canadian Dollars.

    1.15 We have the right to verify Your Account information at any time and suspend Your Account pending adequate verification. You are asked to keep Your registration details up to date. If You change Your address, email, phone number or any other contact or personal information You are obligated to contact Player Support in order to update Your Account information.

    1.16 You agree to receive communications from CASINO TIME.ca and its marketing agents.

    1.17 CASINO TIME.ca does not allow Players to gamble on credit. However, currency usable at CASINO TIME.ca may be available for purchase using credit or debit cards. Neither this nor any part of these Terms and Conditions should, in any way, be construed to imply or infer that Players should seek additional credit in order to play any game or use any feature on CASINO TIME.ca.

    1.18 CASINO TIME.ca allows You to choose Your own user name and password combination, subject to any requirements we may have. You are asked to keep this information confidential and not share it with third parties, nor allow third parties to access Your Account. You are responsible for all actions carried out through Your Account if Your user name and password have been entered correctly. We will not be held liable for security weaknesses on devices or shared passwords. Players will refrain from using obscene or offensive usernames or aliases. Should a Player elect to do so we reserve the right to close Your Account. You can change your password at any time on “My Profile” page. The platform is designed to automatically log players out of the session after a certain period of inactivity.

    1.19 All Player offers are limited to one per person, family, household address, email address, telephone number, debit/credit card and shared computer, e.g. school, public library or workplace. All CASINO TIME.ca offers are intended for recreational players and we may in our sole discretion limit the eligibility of Players to participate in any promotion. We reserve the right to withdraw the availability of any offer or all offers to any Player or group of Players.

    1.20 We reserve the right to reclaim all bonuses awarded and any winnings accrued if Players are found to be tampering with or abusing any aspect of a CASINO TIME.ca promotion. Where there is evidence of a series of bets placed by a Player or group of Players, which due to enhanced payments through promotional offers results in guaranteed Player profits irrespective of the outcome, we reserve the right to ignore the bonus element of such offers and settle bets at the correct odds. We further reserve the right to ask any Player to provide sufficient documentation for us to be satisfied in our absolute discretion as to the Player’s identity prior to us crediting any bonus, free bet or offer to their account.

    1.21 By registering, You are deemed to have accepted and understood all the Terms and Conditions, Privacy Statements, and other rules, regulations, limitations, and other information displayed on the Website or otherwise provided to You by CASINO TIME.ca. We recommend that all Players print out (or save to file) all transaction records, Guides, cancellation policies, and pay-out policies.

    1.22 If using a credit or debit card, the Player’s name MUST be the same as the name used when registering with the Website. Where this is not the case we may suspend Your Account. If Your Account is suspended, You may contact customer support for details of our verification process at the following email address: customersupport@casinotime.ca Any withdrawals that are made by bank wire or cheque will only be payable to the name used when registering with the Website and if a debit or credit card has been used to deposit funds the name must correspond to the name registered on the card.

    1.23 When updating or adding additional payment details it is Your responsibility to make Yourself aware of the terms upon which Your payments are accepted. You are solely responsible to keep informed of any changes.

    1.24 We have an obligation to remit funds to players within a reasonable amount of time. Uncontested funds pending for withdrawal may be reversed back to the CASINO TIME.ca account should Players not respond or abide by the withdrawal requirements. Should withdrawals be reversed they will be available for play within CASINO TIME.ca. CASINO TIME.ca will not be held liable for funds used for gambling or playing.

    1.25 All applicants may be sent an email to the registered email address for account activation. All accounts may be activated by following the instructions in this email. If this is not completed, CASINO TIME.ca reserves the right to suspend all activities on the account until the account details are verified.

    1.26 No Player Account is permitted to have a negative funds balance. Further, no bet will be accepted that might result in a negative balance. If, for any reason, a Player Account reaches a balance below zero ($0.00) dollars, the account will be suspended. Aside from deposits, no transactions will be permitted until the Player Account balance is above zero ($0.00) dollars.

    1.27 There may be some instances in which it may be necessary for CASINO TIME.ca to perform adjustments to Player Accounts and/or Player Account balances. In the event that such adjustments are necessary, only authorized personnel will be permitted to make those adjustments. All adjustments to Player Accounts and Player Account balances will be recorded and logged completely, clearly, and accurately by CASINO TIME.ca including, at a minimum, the specific reasons for such adjustment.

    1.28 Players are not permitted to transfer funds from one Player Account to another. Any attempt to do so shall be considered a violation of this Agreement.

    2. YOUR WARRANTIES

    2.1 You warrant and represent, and we enter into this Agreement on the basis of and in reliance on such representations and warranties, all of which are material at the time of Your entering into this Agreement and throughout the terms hereof, that You:

    1. Are legally able to participate in online gaming at CASINO TIME.ca;
    2. Are 19 years of age or older;
    3. Shall not register for or attempt to register for multiple Player Accounts;
    4. Are not attempting to create an account as a Self-Excluded individual;
    5. Shall not allow any third party (in particular, but without limitation, any minor) to directly, or indirectly, use Your Account utilize the Software or accept a prize from CASINO TIME.ca;
    6. Are not an employee, executive officer, board member, partner of CASINO TIME.ca;
    7. Are not an employee or an executive of any trade union representing or negotiating on behalf of employees of CASINO TIME.ca;
    8. Are not an officer, board member, employee, or are otherwise affiliated with the AGCO, OLG, or iGO;
    9. Do not have access to non-public information that may impact the outcome of any game, event, or bet type;
    10. Shall immediately cease playing, betting, or otherwise accessing Your Player Account if You, at any time, are unable to comply with any requirement established in #5 through #8 herein, until such time that You are able to fully comply;
    11. Have furnished us with personal details that are valid, accurate and complete in each and every respect and that You shall advise us immediately via email should such details change;
    12. Are the true and lawful owner of the monies that You wager at CASINO TIME.ca and that You are duly and properly authorized to utilize such monies for the aforementioned purposes;
    13. Shall not deposit nor wager any monies at CASINO TIME.ca that are derived in any manner whatsoever from illegal activities outlined in Section 14 (Money Laundering) below;
    14. Are not involved in cheating or collusion;
    15. Shall pay all monies owed to CASINO TIME.ca, and in respect to any payment, shall not cause any Charge-back, or otherwise deny or reverse or countermand any such payments;
    16. Have read and understood these Terms and Conditions; and
    17. Participate at CASINO TIME.ca on an individual basis and for personal entertainment only (that is, not in a professional sense or in concert with other Players as part of a club, group, etc.).

    2.2 If You breach the warranty contained in 2.1 above, all transactions placed by You shall be null and void and You shall forfeit any winnings accrued to You as a result of such transactions or participation. Your account may be restricted, suspended or closed.

    3. ADDITIONAL DOCUMENTS COMPRISING PART OF THIS AGREEMENT

    This Agreement incorporates by reference the terms, conditions, policies, statements and explanations of other documents, including:

    1. the applicable Pay-to-Play Game Rules;
    2. the Responsible Gambling Statement – Please Play Responsibly;
    3. the applicable Bonus Funds Terms;
    4. CASINO TIME Privacy and Cookie Policy;
    5. any applicable website user agreement; and
    6. any applicable mobile application user agreement.

    In the event of any conflict or inconsistency between any provision of this Agreement and any of such other terms, conditions, policies, statements and explanations, the order of precedence shall be in descending order of clauses i. to vi. above.

    4. PLAYER ACCOUNT INFORMATION

    Information that is submitted by You when registering an account with CASINO TIME.ca must be true, accurate and complete at the time it is provided to CASINO TIME and such information must remain true, accurate and complete following the registration of a Player Account. You are required to attest on an annual basis, and at the time of registration, that You are verifying the information contained in Your player account is complete, accurate and up to date. You will be unable to wager or play until the annual attestation is made.

    You must tell us, at the time you register and open your Account, if you are a domestic politically exposed person in Canada (“domestic PEP”), a foreign politically exposed person (“foreign PEP”), a head of an international organization (“HIO”), together with domestic and foreign PEP’s, (“PEP/HIO”), or the family member or close associate of a PEP or HIO (a “PEP/HIO Related Person”). You must also immediately tell us if your PEP/HIO or PEP/HIO Related Person status changes at any time while your account is open.

    Fit to play attestation is included as Player Account information required to maintain a gaming account. You must confirm upon each login that You are “fit to play” and not under the influence of any substance that may impair Your judgement or are fatigued. If attestation is left unchecked, You will not be able to play, deposit or withdraw until the attestation of fit to play is completed.

    5. PLAYER PRIVACY – YOUR CONSENT

    Casino Time’s Cookie and Privacy Policy explains how we collect, use, store and disclose Your information and is hereby incorporated into this Agreement. You expressly acknowledge that You have reviewed the Cookie and Privacy Policy and agree to the practices described therein. Our Cookie and Privacy Policy can be found via a link in the footer of our website.

    Consistent with our Privacy Statement and subject to the limitations therein, by registering an account, You hereby consent to us contacting You through various means of communication such as via email or SMS, in respect of matters relating to Your Account. To unsubscribe to any or all forms of communication, please contact us at customersupport@casinotime.ca.

    6. PLAYER ACCOUNT

    A Player can access the details of their Player Account through the CASINOTIME.ca website by going to the “My Account” page including, for example, to see the following information:

    1. the Player's registration information, including Player Contact Information.
    2. the Player's Username and Password, as well as related security questions and answers.
    3. the current notional balance of the Player Account.
    4. the financial transaction history associated with the Player Account; and
    5. the game-play history associated with the Player Account.

    If a Player discovers any inaccuracy or error in the information that is contained in their Player Account, or if the Player suspects that such an inaccuracy or error may exist, regardless of who is responsible for the inaccuracy or error, the Player is required to immediately contact Customer Support customersupport@CasinoTime.ca.

    Casino Time reserves the right to place a wagering limit restriction on player accounts who demonstrate a pattern of experiencing potential harm during gaming.

    7. DEPOSITS INTO PLAYER ACCOUNT

    7.1 Funding A Player Account

    In order to play Games (other than Play-for-Free Games) on CASINOTIME.ca, a Player is required to have a positive notional balance of funds in their Player Account. All funds in a Player Account reflect CAD dollar amount as foreign exchange transactions are not permitted on the website. CASINO TIME does not accept crypto currency or Prepaid Cards. Further, CASINO TIME does not permit You to deposit Cash at our Land-Based Affiliate Sites to fund their iGaming Accounts. A Player is solely responsible for ensuring that their Player Account contains sufficient funds for a Game (including any Future Game Transaction), and CASINO TIME does not undertake any obligation or responsibility for notifying a Player if they do or may have insufficient funds available to play a particular Game prior to rejecting the relevant transaction (provided that the foregoing will not restrict CASINO TIME’s ability to so notify a Player).

    In addition, subject to certain exceptions, any monetary Prizes from Games that are played through CASINOTIME.ca will be loaded to the Player Account by means of a credit to the notional balance of such Player Account. The withdrawal of funds representing such Prizes from a Player Account will be subject to the terms and conditions of this Agreement. Instructions for claiming non-monetary Prizes will be provided to Players by CASINO TIME from time to time.

    7.2 Means Of Depositing Funds

    A Player may fund their Player Account by depositing funds (in Canadian dollars only) with CASINO TIME by means of:

    1. an Interac Online payment from a Player’s bank account that the Player is an authorized user, as defined by the bank, to access for such purpose. When Interac Online is selected as the payment option, a Player will be redirected to the online banking website for their bank. CASINO TIME will not collect online banking login or password information.
    2. An electronic funds transfer (EFT) from a Player’s bank account that the Player is an authorized user, as defined by the bank, to access for such purpose. When EFT is selected as the payment option, a Player will be redirected to the online banking website for their bank.
    3. a Visa or MasterCard credit card issued by a financial institution which the Player is an authorized user, as defined by the financial institution, to use the Visa or MasterCard credit card for such purpose. Players should be aware that some credit card issuers may treat the funding of a Player Account as a cash advance and charge a fee for each such credit card transaction. Any cash advance fee or other fees relating to the use of a credit card are the Player’s sole responsibility.
    4. a Visa Debit card issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Visa Debit card for such purpose.
    5. a Debit Mastercard issued in Canada by a Canadian bank or financial institution, which the Player is an authorized user, as defined by the Canadian bank or financial institution, to use the Debit Mastercard for such purpose.

    A Player should familiarize themselves with the terms and conditions that govern the use of their chosen funding method prior to using it to fund a Player Account. Banks and financial institutions may charge a fee. Any such fees are the Player’s sole responsibility.

    No other means of funding the notional balance of a Player Account is permitted as of the date of this Agreement. The merchant associated with any deposit transaction will be “Casino Time Inc.”

    Each time a Player uses a credit card, Visa Debit card, Debit Mastercard, EFT, Apple/Google Pay or Interac Online, to make a deposit with CASINO TIME for purposes of funding the notional balance of a Player Account, they will be deemed to represent and warrant to CASINO TIME, that the Player has all necessary rights and authority to use such credit card or the funds in the relevant bank account, or funding account for such purposes. Rights and authority also include circumstances in which the credit card, bank account or funding account is jointly held with one or more other persons.

    CASINO TIME will hold a Player's monies that are deposited with CASINO TIME for purposes of funding the notional balance of a Player Account in a bank account or escrow account as trustee for the Player (not as banker or debtor). Notwithstanding anything to the contrary contained in this Agreement, CASINO TIME will deal with a Player's money that has been deposited with CASINO TIME as a trustee, and nothing contained herein shall create or give rise to any obligation on the part of CASINO TIME to repay any money to the Player as the Player's debtor.

    For the avoidance of doubt, a Player Account is not a bank account and, therefore, is not insured, guaranteed, sponsored or otherwise protected by any deposit or banking insurance system. Funds deposited with CASINO TIME for purposes of funding the notional balance of a Player Account, and monetary Prizes that are credited to a Player Account, will not accrue interest for the benefit of the Player, and the Player shall not be entitled to claim any interest from CASINO TIME in respect of any such funds.

    In the event that any amount becomes owing to CASINO TIME by the Player under or in accordance with the terms of this Agreement, CASINO TIME shall have the right to deduct such amounts from the Player's Unutilized Funds and to adjust the notional balance of funds in the Player Account accordingly without the requirement for any advance or further notice to be provided to the Player by CASINO TIME.

    7.3 Deposit Limits

    In addition to any deposit limits established by a Player, CASINO TIME (in its sole discretion) may restrict a Player's ability to fund the notional balance of a Player Account. For example, CASINO TIME may:

    7.3.1 establish minimum and maximum amounts of funds that may be deposited by a Player with CASINO TIME for the purpose of funding the notional balance of a Player Account, on a transaction-by-transaction basis or during one or more time periods.

    As of the date of this Agreement, deposit limits are as follows:

    Minimum Deposit and Withdrawal Amount is $10.00

    7.3.2 limit the number of different credit cards that a Player can use to fund a Player Account (3). In addition, a particular credit card may not be registered with more than one Player Account.

    7.3.3 restrict a Player's ability to change deposit methods during specified periods of time.

    7.3.4 restrict a Player's ability to change certain credit card information or otherwise impose conditions prior to changing credit card information (for example, requiring that the Player contact Customer Support); or

    7.3.5 change acceptable methods of payment.

    Prior to a Player depositing any money with CASINO TIME for the purpose of crediting their Player Account, subject to the deposit limits set by CASINO TIME, the Player may, at their discretion, set : A maximum weekly deposit limit for their Player Account. A Player who subsequently desires to change their personal weekly deposit limit may do so subject to the following:

    1. if the Player is lowering the maximum limit, the change will have immediate effect.
    2. if the Player is increasing the maximum limit (subject to any limits prescribed by CASINO TIME in its sole discretion), the change will not become effective until a minimum cooling off period of twenty-four (24) hours has elapsed.

    8. CHARGEBACKS

    If a Player funds the notional balance of their Player Account and thereafter a Chargeback occurs in respect of all or part of the deposit transaction, CASINO TIME (or any of its third- party service providers) may take any or all of the following actions, in each case as CASINO TIME, in its sole discretion, determines to be appropriate:

    8.1 Suspend the Player Account pending resolution of any dispute relating to the Chargeback in accordance with Section 17.1 – “Suspension of a Player Account”.

    8.2 Request that the Player contact Customer Support to explain the circumstances of the Chargeback.

    8.3 Debit the Unutilized Funds in the Player Account with the amount of the Chargeback. If that debit results in a negative balance of Unutilized Funds in the Player Account, the amount of the negative balance will constitute a debt owed by the Player to CASINO TIME, and CASINO TIME reserves the right to recover such amount from the Player.

    8.4 Deactivate the Player Account and exclude the Player from playing Games on CASINOTIME.ca (i.e., deem the individual to thereafter be an Excluded Individual); or

    8.5 initiate a dispute resolution process with the relevant bank or financial institution, which may include CASINO TIME providing evidence relating to the deposit transaction and/or Chargeback to a payment processing service provider and/or a bank or financial institution.

    9. WITHDRAWALS FROM A PLAYER ACCOUNT

    9.1 Methods Of Withdrawing Unutilized Funds

    Subject to certain exceptions, withdrawals of Unutilized Funds from a Player Account will be processed by means of an electronic bank transfer (in Canadian dollars only) to a bank account that is registered by the Player and which CASINO TIME has verified and approved, to its satisfaction, is held by the Player at a bank or other financial institution acceptable to CASINO TIME in Canada. A Player is not permitted to designate a bank account for such purposes that is not held by the Player (alone or together with other persons). A player is not permitted to transfer funds between player accounts.

    The Player acknowledges and agrees that:

    1. CASINO TIME will require the Player to submit documentation (by electronic upload via CASINOTIME.ca or as CASINO TIME may otherwise instruct) that, in CASINO TIME's sole determination, evidences the Player's authority over the bank account that is to be registered. For example, CASINO TIME may require a copy of a void cheque or a bank account statement, in either case which includes the Player's name, civic address and the bank account number, all of which must match the information associated with the Player Account that is stored in CASINO TIME's iGaming Platform.
    2. by submitting such documentation to CASINO TIME, the Player will be deemed to represent and warrant to CASINO TIME that such documentation is a true, accurate and complete copy of the original.
    3. if the Player registers a bank account that is held jointly with one or more other persons, withdrawals of Unutilized Funds from their Player Account will be paid into such joint account and, therefore, may be accessed by the other; and
    4. A Player may request a withdrawal of unutilized funds on their choice of registered payment methods authorized and setup on the Casino Time website.
    9.2 Withdrawal Limits And Limitations

    Subject to the terms and conditions of this Agreement, a Player may withdraw Unutilized Funds from their Player Account up to the then-current balance of Unutilized Funds. Free bets or promotional awards of any kind cannot be withdrawn.

    A Player will not be entitled to withdraw Unutilized Funds from a Player Account through CASINOTIME.ca at any time that a Player Account is Suspended unless CASINO TIME, in its sole discretion, determines that the withdrawal (in whole or in part) will be permitted. If a Player Account is Suspended and the Player wants to make a withdrawal of Unutilized Funds, the Player must contact Customer Support.

    CASINO TIME may from time to time specify minimum and maximum withdrawal amounts applicable to Player Accounts.

    CASINO TIME may from time to time limit the number of withdrawals of Unutilized Funds by a Player that a Player can make during a specified period of time.

    9.3 Withdrawal Cancellations

    CASINO TIME may, in its discretion, refuse a withdrawal request if CASINO TIME suspects such withdrawal is made in breach of this Agreement (whether or not such violation is a Material Breach). CASINO TIME will make reasonable efforts to promptly notify the Player of such refusal via the Player Contact Information associated with the Player Account.

    A Player may cancel their withdrawal request through their Player Account. Provided such cancellation has not been processed by CASINO TIME, the relevant funds will be returned to the Unutilized Funds in the Player Account.

    9.4 Withdrawal Processing Times

    Following a Player's request to withdraw Unutilized Funds from their Player Account and the satisfaction of all other terms and conditions for a withdrawal (including providing any required information or documentation to CASINO TIME), in most circumstances CASINO TIME will be able to process the withdrawal within seven (7) calendar days. In some circumstances, a longer period of time for processing a withdrawal may be required. CASINO TIME will not be required to notify the Player of any delay associated with the processing of a withdrawal of Unutilized Funds or the reason for such delay unless additional information or documentation is required to be provided by the Player.

    Winnings over $10,000.00 in a single sum or aggregated within 24 hours may be subject to a review process by third parties for validation of the win. Funds may not be deposited into the player account until completion of review.

    10. RESPONSIBLE GAMING

    Casino Time recognizes that while gambling can be fun, it may also be addictive. As such, Casino Time has made available various tools for You to use such as setting Deposit Limits, Loss Limits, Session Limits, Reality Check.     11. BONUS FUNDS TERMS

    11.1 Bonus Funds

    From time-to-time CASINO TIME may, in its sole discretion, whether for promotional purposes or otherwise, offer to upload Bonus Funds into a Player Account, subject to the Player (in their discretion) accepting the offer of the Bonus Funds. Bonus Funds have a notional monetary value only, so they are not Unutilized Funds at the time they are awarded. A Player is not entitled to receive Bonus Funds unless CASINO TIME, in its sole discretion, determines that Bonus Funds should be offered to a particular Player. A Player will not be obligated to accept Bonus Funds. A Player can forfeit Bonus Funds at any time by contacting Customer Support.

    CASINO TIME will have the right to determine the qualification criteria for all promotions and awarding of Bonus Funds. The criteria will be specified in the terms and conditions that CASINO TIME determines are applicable to any specific Bonus Funds, and any use of such Bonus Funds must comply with the applicable terms and conditions relating thereto (the “Bonus Funds Terms”). All Bonus Funds Terms will be deemed to be incorporated by reference in this Agreement, and in the event of any inconsistency between the Bonus Funds Terms and the terms and conditions of this Agreement, the Bonus Funds Terms shall govern to the extent of the inconsistency.

    The awarding and availability of Bonus Funds are in CASINO TIME's sole discretion. The use of Bonus Funds may be limited to specific Games and specific periods of time, and Bonus Funds may expire and be cancelled if they are not used prior to a specified date or time. The applicable Bonus Funds Terms should be consulted. In addition, CASINO TIME may cancel Bonus Funds that have been uploaded into a Player Account at any time in its sole discretion.

    11.2 Using Bonus Funds

    If a Player who wants to play Games (other than Play-for-Free Games) has both Bonus Funds and Unutilized Funds in their Player Account (regardless of whether the awarding of the Bonus Funds preceded or followed the credit of notional funds to the balance of the Player Account, whether resulting from a deposit of funds with CASINO TIME by the Player or the winning of a Prize by the Player),the Unutilized Funds will be used first to play the eligible Games until all of the Unutilized Funds have been utilized, following which time the Bonus Funds will be used.

    The Bonus Funds Terms may contemplate that certain Bonus Funds will become Unutilized Funds only after certain wagering requirements have been satisfied. A Player should review the applicable Bonus Funds Terms prior to accepting an offer of Bonus Funds. If a Player does not accept the applicable Bonus Funds Terms in their entirety, then the Player must not accept the relevant Bonus Funds or opt-out of the promotion in accordance with such Bonus Fund Terms.

    All bonus offers can be redeemed only once per offer unless it is clearly stated otherwise. Each bonus offer will have its own “Bonus Funds Terms” and you should ensure that the Terms of Use associated with each individual bonus offer are read and understood prior to accepting the bonus.

    In the event of an error when attributing a bonus to your account, the company reserves the right to correct such errors by removing any funds that were put into your account erroneously and by voiding any bets that were placed by these funds.

    In case of bonus manipulation or abuse of any kind, we reserve the right to deduct the bonus and the winnings associated with the bonus from your account.

    12. CASINO TERMS

    12.1 Random Number Generator

    You fully accept and agree that random number generator (“RNG”) software will determine all outcomes of Games on Casinotime.ca. including online Bingo. In the event of a discrepancy between the results displayed on your computer and a Game’s records on our server, our records shall be regarded as definitive.

    12.2 Disconnection, Misuse and Malfunction

    12.2.1 We, our affiliates, agents and licensors accept no responsibility and will not be liable for any loss resulting from delays or interruptions to play due to failure, breakdown, malfunction, interruption of or disconnection from the games server or any other causes over which we or they have no control.

    12.2.2 Misuse, disconnection or system malfunction voids all bets, plays and pays.

    12.2.3 You certify that pertaining to the services provided by us, you will not use or attempt to use any martingale betting strategy or software endowed, in our view, with artificial intelligence. Abuse of the website or services provided by us, is prohibited.

    12.2.4 In the event that we reasonably determine that you used or attempted to use a product endowed with artificial intelligence in conjunction with our website or services, we reserve the right to rescind or block your account immediately, to not reimburse the amount credited to your account, and prohibit your access to all other Websites, Service and Applications offered by us.

    12.2.5 In the interest of fair play, we prohibit the use of any recognized betting techniques with the aim of circumventing the standard house edge in our games. If your account shows any indication of deceptive game play through these betting techniques, your account will be suspended immediately, and we will retain any funds from the account in question.

    12.2.6 Should we have any reason to believe that either an account or group of accounts are operating systemically e.g. Using specific betting techniques or group wagering, we reserve the right to permanently close all accounts. In these circumstances, we will not be under any obligation to refund you any money in your account with the exception of the amount you originally deposited, should this amount still be present.

    12.2.7 If an issue is detected with a slot game, the slot game can be turned off on the back end, until further notice allowing time for full investigation and reporting to the Registrar. An auditable trail of the investigation shall be completed and kept as per the record retention policy.

    12.2.8 In any case where there is a game or system fault, including where game outcomes are not recoverable, players who have been determined to be out of pocket will be refunded the correct amount.     12.2.9 Peer-to-peer games are not provided by Casino Time. Peer-to-peer software is not permitted and if a player is found to use such software it will be considered to be cheating and Casino Time may sanction the player accordingly.

    13. EXCLUSION, DEREGISTRATION OR SUSPENSION (SEE ALSO SECTION 17)

    13.1 Notwithstanding anything to the contrary contained herein, any Player Account shall be terminated on request of iGO or the Alcohol and Gaming Commission of Ontario (“AGCO”).

    13.2 You have the right to deregister or terminate Your Player Account at any time. Once such election is made, Your Account will be deactivated and You will have the right to collect the remaining account balance pursuant to Section 16 “Closures of a Player Account by the Player” of this Agreement.

    13.3 If You elect to Self-Exclude from Casino Time.ca:

  • You will immediately be prohibited from conducting any future gaming transaction throughout the term of Your Self-Exclusion;
  • You will be removed from Casino Time marketing lists;
  • For purposes of this section, once a player self excludes, the wager is brought to an end:
    • Casino Time shall refund a player’s wager if the player enrolls in a self-exclusion program prior to the commencement of an event or series of events on which the outcome of the wager is determined.
    • Casino Time will not refund a player’s wager if the player enrolls in a self-exclusion program after the commencement of an event or series of events on which the outcome of the wager is determined. Events also include bonus funds and entries into any promotions occurring during the self-exclusion period as the player forfeits these events with enrollment in the program.
  • During the self-excluded period, You will not be able to login to Your account and shall not attempt to create additional Player accounts.
  • You will sign a self-exclusion agreement attesting to Your understanding of the inability to login or access Your account during the specified time period. The self-exclusion agreement also details the terms and conditions of the self-exclusion program.
  • If You violate the terms of the self-exclusion agreement, You could forfeit future access to Your account.
  • You will only be allowed to return to Your account and gaming platform once the self-exclusion term ends and only by contacting Casino Time customer service.
  • 13.4 If we deregister, exclude or suspend You from the CasinoTime.ca site we shall have the right to:

    13.4.1 withhold payment to You of any contested funds whether such contested funds are deposits, refunds, bonuses, free monies, CasinoTime.ca credits, payouts or the like;

    13.4.2 determine what criteria You shall have to meet in order to establish a new Account on CasinoTime.ca; and

    13.4.3 in the case of fraudulent, illegal or similar misconduct by You or failure by You to pay any sums due to us, we have the additional rights to:

    13.4.3.1 furnish any relevant information about You and share Your Account details with a collections agency for the recovery of, any sums that You owe us as permitted by law, and You hereby irrevocably authorize us to do so in our absolute discretion; and

    13.4.3.2 retain any contested funds that may be derived by You from fraudulent, illegal or similar misconduct.

    13.4.4 If an account is removed, deactivated, or deleted for any reason, we shall retain all associated Player Information in accordance with AGCO Standard 1.09 or other records retention requirements as applicable.

    13.4.5 Any funds in the players account at the time of self-exclusion registration can be requested by the player to be withdrawn by contacting Casino Time customer service. Players may also contact the Casino Time Customer Service while in the program to request the withdrawal of funds. The requests are processed once a week. Any pre-purchased online Bingo tickets will be cancelled by Casino Time with the funds returned to the player.

    14. MONEY LAUNDERING

    14.1 There are strict laws on money laundering that may impose an obligation upon us to report You to the applicable authorities if we know, suspect or have reason to suspect that any of Your transactions, amongst other things, involve funds derived from illegal activities or are intended to conceal funds derived from illegal activities or involve the use of CasinoTime.ca to facilitate criminal activity.

    14.2 If we have knowledge or suspect that Your use of the Website or CasinoTime.ca, is illegal or otherwise improper, we may:

    14.2.1 immediately suspend, deactivate or terminate Your Account at CasinoTime.ca; and

    14.2.2 at our discretion, not to be exercised unreasonably, refuse to refund to You any funds held in such account.

    14.3 We reserve the right to report You to applicable authorities should we, in our absolute discretion, determine that we are obliged by law to do so.

    15. INACTIVE AND DORMANT ACCOUNTS

    15.1 Inactive Accounts

    A Player Account will become an Inactive Account if there has not been a successful Player-Initiated Transaction for a period of 12-consecutive months unless the Player Account is for a Self-Excluded Individual or is on the Excluded List.

    If the Future Game Transaction associated with such a Player Account expires or is suspended or cancelled for any reason, the foregoing 12- month period will be calculated beginning on the day that the last Future Game Transaction is processed from the Player Account, being the last Player-Initiated Transaction.

    A Player Account that has become an Inactive Account (no activity for 12 consecutive months) will cease to be an Inactive Account following the successful completion of a Player-Initiated Transaction.

    An Inactive Account (12 months of no player account activity) will be subject to the following monthly service fees (“Inactive Account Fees”), the amount of which CASINO TIME will be entitled to withdraw from the Unutilized Funds associated with the Player Account at the end of each month (or at any time thereafter) without the requirement for any advance or further notice to the Player.

    The monthly Inactive Account Service Fee is $5 per month (or if the balance of the Player Account is less than $5, then that balance). The monthly Inactive Service Fee will continue until the earlier of:

    • The balance of Unutilized Funds is zero; or
    • The Inactive Account becomes active; or
    • The Player requests to recover the balance of their Account.
    15.2 Dormant Accounts

    An Inactive Account will become a Dormant Account if the Player does not successfully complete a Player-Initiated Transaction within the 12-month period immediately following the date on which the Player Account becomes an Inactive Account (i.e., the Player has not successfully completed a Player-Initiated Transaction for 24 consecutive months).

    When a Player Account has become Inactive for 24 consecutive months, the Player will be contacted via contact methods on file. The player will have 30 days to respond. Should a player continue to show inactivity during those 30 days, the account will be made Dormant by CASINO TIME subsequent to the end of the 30 day notice period and subsequently Deactivated.

    Once the Player Account is Dormant (closed), the Player will not be able to log into or use the Player Account. Subject to the minimum withdrawal requirements in Section 9.2 and documentation requirements in Section 1.11, CASINO TIME will deposit an amount equal to the Unutilized Funds as at such date into the bank account that is associated with the Player Account, the details of which are stored by CASINO TIME on the iGaming Platform. In the event that no bank account is associated with the Player Account, or if CASINO TIME is not able to successfully deposit the Unutilized Funds in such bank account (for example, because the bank account has been closed or because CASINO TIME requires additional information in order to confirm that the bank account belongs to the Player), CASINO TIME will use its reasonable efforts to contact the Player using the Player Contact Information on file to advise as to the status of the Player Account and the balance of Unutilized Funds. If CASINO TIME is unable to contact the player within three (3) months of the Player Account becoming a Dormant Account, the remaining balance of Unutilized Funds may be forfeited to CASINO TIME.

    15.3 Reactivation Of A Dormant Player Account

    CASINO TIME will retain information relating to a Dormant Account in the iGaming Platform in accordance with its record retention policies. If a Player wishes to reactivate the Dormant Account, they are required to contact Customer Support. The Player may be required to take additional steps to verify their identity in order to complete the reactivation process.

    Once the Account is reactivated, it will have the same account details as those which existed as of the date the Player Account became a Dormant Account. In the event that any of the relevant information has changed (for example, the Player Contact Information), the Player will be solely responsible for updating such information and complying with the terms and conditions of this Agreement which are then in effect.

    16. CLOSURES OF A PLAYER ACCOUNT BY THE PLAYER

    A Player may close their Player Account at any time through the "My Account” – “Account Closure” – “Close Account” section of their profile or by contacting Customer Support. If a Player is no longer eligible to have a Player Account (for example, if the Player will be relocating to a jurisdiction outside of the Province of Ontario, or if the Player becomes an Excluded Individual), the Player is required to Close their Player Account.

    Player Self Closure
    The player must either withdraw all remaining unutilized funds prior to commencing account closure, subject to the minimum withdrawal requirements in Section 9.2 or play their account balance to zero and then commence account closure process.

    Player contacts customer support to close account
    When a player contacts customer support, the support center agent will encourage the player to withdraw remaining unutilized funds to zero, prior to commencing account closure, subject to the minimum withdrawal requirements in Section 9.2. If the unutilized funds balance is below the minimum withdrawal requirement ($10 CAD) the agent will make an administrative adjustment to the account equal to the remaining balance forcing the account to a zero balance. Customer Service will then complete the account closure process.

    Notwithstanding the Closure of the account, CASINO TIME will retain a Player’s information in accordance with its record retention policies.     Upon Closure of a Player Account the Player Account will no longer be accessible by the Player. All Future Game Transactions associated with the Closed Player Account that have not been completed by the time of Closure will be cancelled. The account will remain closed for a minimum of 30 days after which the Player can contact Customer Support to request re-opening. Casino Time will review the request to determine if the account can be reopened. If approved Casino Time will contact the Player advising the account has been reopened as requested.

    17. DEACTIVATION OR SUSPENSION OF A PLAYER ACCOUNT IN CASINO TIME'S DISCRETION

    17.1 Suspension Of A Player Account

    CASINO TIME shall have the right to suspend a Player Account at any time in its sole discretion (a “Suspended Account”). Without limiting the foregoing, and by way of example only, CASINO TIME may Suspend a Player’s access to their Player Account if it suspects that the Player has improperly initiated a Chargeback or has committed any breach of this Player Agreement, applicable law, Game Rules, and/or the Pay- to-Play Game Rules. While a Player Account is Suspended:

    17.1.1 A Player will be unable to access their Player Account.

    17.1.2 A Player will be unable to withdraw any Unutilized Funds unless they contact CASINO TIME customer service.

    17.1.3 All Future Game Transactions associated with the Suspended Player Account will be suspended and/or cancelled (i.e., no purchase or other financial transaction in respect thereof that has not been completed at the time the Player Account is Suspended will be completed); and

    17.1.4 A Player may be required to cooperate with any investigations conducted by CASINO TIME into the Player’s conduct prior to the Suspension being lifted (including provisions of additional documentation or information as requested by CASINO TIME). Failure to cooperate with this subsection shall be deemed a Material Breach of this Agreement.

    If, during the Suspension, CASINO TIME determines that the Player has committed a Material Breach of this Agreement, it may Deactivate the Player Account in accordance with Section 17.2.

    17.2 Deactivation Of Player Accounts

    CASINO TIME shall have the right to deactivate a Player Account at any time in its sole discretion (a “Deactivated Account”).

    If CASINO TIME Deactivates a Player Account, a Player will be unable to login or access their Player Account. CASINO TIME will deposit an amount equal to the Unutilized Funds as at such date into the bank account that is associated with the Player Account (subject to the minimum withdrawal requirements detailed in Section 9.2 and additional documentation requirements in Section 1), the details of which are stored by CASINO TIME on the iGaming Platform. In the event that no bank account is associated with the Player Account, or if CASINO TIME is not able to successfully deposit the Unutilized Funds in such bank account (for example, because the bank account has been closed or because CASINO TIME requires additional information in order to confirm that the bank account belongs to the Player), CASINO TIME will use its reasonable efforts to contact the Player using the Player Contact Information. If CASINO TIME is unable to contact the Player, then CASINO TIME will retain the Unutilized Funds until CASINO TIME receives proper instructions relating to the disposition of such funds from the Player or their legal representative.

    Notwithstanding the foregoing, if CASINO TIME Deactivates a Player Account as a result of the occurrence of a Material Breach by the Player under this Agreement, CASINO TIME (in its sole discretion) shall be entitled to treat any or all of the Unutilized Funds as forfeited by the Player, in which case the Player will not be entitled to have the Unutilized Funds returned.

    17.3 Effect Of Deactivation Or Closure Of A Player Account

    Without limiting the foregoing, when a Player Account is a Closed Account or a Deactivated Account:

    1. Any scheduled wagers, bets or purchases (including for Future Game Transactions) that have not been completed prior to the Closure or Deactivation will be cancelled.
    2. the Player will not be entitled to receive any offers for new Bonus Funds, and any existing Bonus Funds associated with the Player Account will be cancelled and the Player will not be entitled to receive any compensation in respect of the cancelled Bonus Funds; and
    3. this Agreement will terminate, except for those provisions which by their nature are intended to survive the termination of this Agreement.

    18. ACCESSING AND USING CASINOTIME.CA

    18.1 Supply And Maintenance Of Player Equipment And Services

    You are solely responsible for supplying and maintaining all equipment, technology and services that they require to access and use CASINOTIME.ca. The performance or operation of CASINOTIME.ca or any website or Mobile Applications that CASINO TIME may make available to Players from time to time may be affected by a Player's computer equipment, mobile device, Internet connection or other factors that are outside of CASINO TIME's control. In some cases, You may not be able to access or use some or all the components or functionality of CASINOTIME.ca as a result of deficiencies in their own equipment or technology or the service providers retained by them. For example, a slow Internet connection could adversely impact the performance or operation of CASINOTIME.ca, or an outdated web browser or the settings on a Player's computer could cause some or all the content of CASINOTIME.ca to display incorrectly or to fail to display.

    CASINO TIME makes no representation or warranty of any kind regarding the compatibility, functionality, performance or operation of CASINOTIME.ca or any component thereof on any of Your computer or other devices used to access CASINOTIME.ca.

    CASINO TIME makes no representation or warranty of any kind regarding the compatibility, functionality, performance or operation of CASINOTIME.ca or any component thereof on any device used at a land-based gaming affiliate site of CASINOTIME.ca. Affiliate sites own and maintain their own devices and provide their own internet connection service providers to access CASINOTIME.ca. Affiliate sites are not owned, operated or controlled by CasinoTime.ca. Players may require additional third-party services to access CASINOTIME.ca (e.g., internet service provider agreement; mobile carrier agreement; email account; text messaging service (SMS)). The Player is solely accountable for any agreements and charges related to these third-party services. A Player should familiarize themselves with the terms and conditions that govern any such services prior to using them to access CASINOTIME.ca.

    18.2 Third-Party Content; Joint Games

    To access or use certain components of CASINO TIME.ca, it may be necessary for You to download software (for example, certain casino games may require a flash player or an up-to-date web browser.)

    Certain third-party product providers may require You to accept and agree to additional terms and conditions governing the use of their products. It is the sole responsibility of You to determine whether they accept and agree to any such third-party terms and conditions, and if You do not accept and agree to them, such third-party product should not be used.

    CASINO TIME shall not be liable for any direct or indirect damage to, or loss of data from, Your equipment that may arise from or as a result of the access or use of CASINOTIME.ca or any content, software or applications made available by or on behalf of CASINO TIME through CASINO TIME.ca.

    Some Pay-to-Play Games may be offered jointly and networked with multiple provincial iGaming jurisdictions. Players playing such Games could face opponents from within Ontario as well as opponents located elsewhere in Canada subject to applicable AGCO Standards and iGO Policies.

    19. CASINO TIME'S INTELLECTUAL PROPERTY RIGHTS

    CASINO TIME is the owner or licensee of all of the copyright, trademarks, domain names, design rights, database rights and all other intellectual property rights in, to and in respect of CASINOTIME.ca and the iGaming Platform, including the content of the foregoing, the Games and any written communications that are sent to You by or on behalf of CASINO TIME (collectively, “CASINO TIME IP Rights”). You shall not be deemed to be granted or to receive any rights in or to any of the CASINO TIME IP Rights except to the extent specifically contemplated in, and subject to the terms and conditions of, this Agreement.

    20. VIRUSES, HACKING AND OTHER OFFENCES

    The access or use of CASINOTIME.ca other than in accordance with the terms and conditions of this Agreement is strictly prohibited. You shall not:

    20.1 knowingly or negligently introduce, or permit the introduction of, any virus, trojan, worm, logic bomb or other material that is or would reasonably be expected to be malicious or technologically harmful to CASINOTIME.ca, the iGaming Platform, any Game or any component of any of the foregoing.

    20.2 access or attempt to gain access to CASINOTIME.ca, the iGaming Platform, any Game or any component of any of the foregoing that they are not entitled to access, including the servers on which CASINOTIME.ca, the iGaming Platform or any Game is stored, or any server, computer or database connected to CASINOTIME.ca, the iGaming Platform or any Game. The foregoing restriction includes any attempt to bypass any security mechanisms included in CASINOTIME.ca, the iGaming Platform or any Game, including those which are intended to protect the security of Player's personal information:

    1. use any software program which, in CASINO TIME's sole determination, is endowed with artificial intelligence (i.e., robots) in connection with the Player's participation in a Game.
    2. attack, whether alone or in combination with others, CASINOTIME.ca by means of a denial-of-service attack or a distributed denial-of-service attack.
    3. translate, reverse engineer, decompile, disassemble, modify, create derivative works based on, or otherwise modify or make any attempt to discover the source code of any software (or any part thereof) that is downloaded through or in connection with the access or use of CASINOTIME.ca.
    4. copy, disclose (including, for example, by posting on any social media, blog, message board or other public forum), transmit or otherwise make available, or remove or alter, any of the content or material that is made available on or through CASINOTIME.ca; or
    5. remove, obscure or alter any notice of any CASINO TIME IP Right (including any designation of copyright or trademark) contained in any content or material that is made available on or through CASINOTIME.ca.

    20.3 A failure to comply with this Section will constitute a material breach of this Agreement by You and CASINO TIME (in its sole discretion) may choose to Deactivate or Terminate Your Player Account – Section 17 or 22, respectively.

    21. COLLUSION, CHEATING, FRAUD AND CRIMINAL ACTIVITY

    Each Player is prohibited from engaging in, and is required to immediately notify CASINO TIME if they aware that another Player is or may be engaging in, any form of collusion, cheating, fraud or criminal activity or otherwise exploiting an unfair advantage involving any Game or other component of CASINOTIME.ca, including in connection with the registration of a Player Account, the deposit of funds with CASINO TIME to the credit of the notional balance of a Player Account, making a bet, wager or purchase of a Game, or the withdrawal of Unutilized Funds.

    21.1 For the purposes of this Agreement, as examples only:
    1. fraud includes the unauthorized use of a credit card as a source of funds to be deposited to the credit of a Player Account.
    2. criminal activity includes money laundering.
    3. an unfair advantage includes the use of any software that could provide a Player with an unfair advantage (including, by way of example only, “bots”, artificial intelligence, machine learning software, malicious code, opponent profiling software, automatic betting software, viruses, worms, or malware); and
    4. an unfair advantage includes the exploitation of a fault, loophole or error in any software that is used in connection with the operation of CASINOTIME.ca (including any Game) or the exploitation of any Error.

    21.2 CASINO TIME will use reasonable efforts to detect and prevent any such collusion, cheating, fraud or criminal activity by Players or the taking of any unfair advantage by Players, but in the event that any such activity occurs and another Player incurs any loss or damage, CASINO TIME will not be liable for any such loss or damage.

    21.3 CASINO TIME shall have the right to notify all third parties which CASINO TIME, in its sole discretion, determines to be appropriate in the event of any actual or suspected collusion, cheating, fraud or criminal activity by any Player or the taking of any unfair advantage by any Player, including the appropriate law enforcement authorities and other third parties that CASINO TIME determines to be appropriate (for example, police services, the AGCO, CASINO TIME's payment processors, Event governing bodies, other operators/providers of sports being platforms, and credit card issuers and brands).

    22. TERMINATION OF ACCOUNT

    We reserve the right to cancel Your Account for any reason whatsoever at any time without notice to You. Any balance in Your Account at the time of such cancellation will be addressed as stated under Section 17 – “Deactivation of Player Accounts”. However, we reserve the right, in our discretion, not to be exercised unreasonably, to void any winnings and confiscate any balance in an account in any of the following circumstances:

    • if You have more than one active Account;
    • if the name on Your Account does not match the name on the credit card(s) used to make deposits on an Account;
    • if You participate in a promotion and cash-in before fulfilling the requirements of that particular promotion;
    • if You provide incorrect or misleading registration information;
    • if You are not of legal age;
    • if You reside in a jurisdiction where participation in CasinoTime.ca games are prohibited by law;
    • if You have allowed or permitted (intentionally or unintentionally) someone else to play on Your Account;
    • if You have not played at CasinoTime.ca on an individual basis for personal entertainment only (that is, You have played in a professional sense or in concert with other Player(s) as part of a club, group, etc.);
    • if we receive Charge-backs or returns via a deposit mechanism used on Your Account;
    • if You are found colluding, cheating, match-fixing, money laundering, or otherwise undertaking fraudulent or illegal gaming activity;
    • if it is determined by us that You have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the CasinoTime.ca site;
    • if You use CasinoTime.ca, Website, or Your Account in bad faith;
    • if You, as part of uploading Your Content to the Services, including the CasinoTime.ca or Mobile Casino:
    • upload, post, email or otherwise transmit any of Your Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise unlawful or objectionable (including, without limitation, nudity and depiction of drug use);
    • harm minors in any way;
    • impersonate any person or entity, including but not limited to a representative of a Casino Time Party, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
    • forge headers or otherwise manipulate identifiers in order to disguise the origin of any of Your Content transmitted through the Services;
    • upload, post, email or otherwise transmit any of Your Content that You do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information or proprietary and confidential
    • information learned or disclosed as part of employment relationships or under nondisclosure agreements);
    • upload, post, email or otherwise transmit any of Your Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
    • upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas that are designated for such purpose;
    • upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, emulate, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    • disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Services are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;
    • interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
    • “stalk” or otherwise harass another person or user;
    • collect or store personal information or data about other Services users, or disclose another user’s personal information or data to any third party;
    • solicit personal information or data from anyone under 19 years of age; or
    • use any “bot,” “hack,” “crack,” or otherwise attempt to circumvent any access control, copyright protection or license-enforcement mechanisms associated with or related to the Services.
    • If we become aware that You have played at any other CasinoTime.ca under any of the circumstances set out above.

    23. ERRORS AND UNAVAILABILITY OF CASINOTIME.CA

    23.1 Casino Time's Errors

    A number of circumstances may arise where a Game-related wager or purchase is accepted by CASINO TIME, or where CASINO TIME awards a Prize, credits a Player Account or processes a withdrawal, in each case in error (an “Error”). As examples only, Errors may include:

    1. where CASINO TIME misstates any Pay-to-Play Game Rules or Bonus Funds Terms, in each case as a result of an obvious error or omission in inputting the information, or as a result of a computer malfunction;
    2. where CASINO TIME credits a Player Account, thereby increasing the amount of Unutilized Funds, as a result of a manual or computer input error; or
    3. where CASINO TIME deposits into a Player's bank account an amount that is greater than the amount of Unutilized Funds in a Player Account.

    23.1.2 CASINO TIME reserves the right to correct any Error in the manner that it deems appropriate in the circumstances, and CASINO TIME's decision shall be final and binding.

    23.1.3 Neither CASINO TIME nor any of its employees, agents or service providers shall be liable for any loss incurred by a Player that results from any Error, including any loss of winnings that results from a forfeiture thereof by the Player as a result of the Error. CASINO TIME shall use reasonable efforts to notify a Player if any Error has adversely impacted the Player, or if the correction of any Error adversely impacts the Player.

    23.1.4 In the event that CASINO TIME pays any money (i.e., by processing a withdrawal) to a Player as a result of or in relation to an Error, the Player shall be deemed to hold such money in trust for CASINO TIME, and CASINO TIME shall have the right to recover such money through a correcting entry to the extent that funds are available in the Player’s Player Account and, if sufficient funds are not available, through a demand for payment to that person which demand the person shall immediately satisfy, to the extent of any deficiency, in accordance with CASINO TIME's reasonable instructions.

    23.1.5 If an Error results in a credit to a Player Account (the amount of such credit being “Error Funds”), any subsequent Game-related bet, wager or purchase may be deemed by CASINO TIME to have been made using the Error Funds, and (i) CASINO TIME may cancel such bet, wager or purchase, and (ii) if any Prize in respect thereof has been credited to the Player Account or otherwise paid or delivered to the Player, the Player shall be deemed to be holding the full amount of such Prize in trust for CASINO TIME, and (iii) upon CASINO TIME making a demand for the return of such Prize, the Player shall immediately return the Prize to CASINO TIME in accordance with CASINO TIME's reasonable instructions.

    23.2 Unavailability Of Casinotime.Ca

    CASINO TIME may temporarily suspend the whole or any part of CASINO TIME.ca or any game or activity for any reason at our sole discretion. CASINO TIME may, but shall not be obliged to, give You as much notice as is reasonably practicable of such suspension.

    Notwithstanding anything to the contrary contained in this Agreement, a Player shall not be entitled to any compensation arising from or as a result of any Downtime including, for example, if a Player is unable to withdraw Unutilized Funds through CASINOTIME.ca or if Bonus Funds expire during the period of any Downtime.

    If a game cannot be continued after a service interruption, players will either be paid the amount won up to that point or bets returned - whichever is the better outcome for the player.

    In the situation where a customer may be negatively affected by feed provider errors, Casino Time will make the proper remedial actions on a timely basis.

    24. DISPUTES

    No claim or dispute by a Player with regard to any wager or purchase of a Game, including the outcome of such Game, will be considered by CASINO TIME if initiated more than 30 days following the date on which the Game is completed.

    CASINO TIME's records, as maintained in the iGaming Platform (and/or CASINO TIME's central computer-controlled online system, in the case of a Draw-Based Lottery Game Played Online), will be the final authority in determining the circumstances of a Player's participation in the relevant Game and the results of such participation. In the event of a disagreement between the result that appears on a Player's screen and the relevant Game servers, the result that appears in the Game servers will prevail.

    If You wish to make a complaint about CASINO TIME or any aspect of CASINOTIME.ca, You may do so by contacting Customer Support or otherwise contacting CASINO TIME in accordance with Section 27.1. You may also contact the AGCO (CASINO TIME's regulator) using the contact information in Section 27.2.

    25. INDEMNITY AND LIMITATIONS OF LIABILITY

    You agree that You are free to choose whether to participate in CasinoTime.ca at CASINO TIME.ca, access and use the Websites and use the Services offered by CASINO TIME and do so at Your sole option, discretion and risk.

    You will indemnify and hold harmless us and our directors, officers, employees, shareholders, subcontractors, agents and affiliates against any and all costs, expenses, liabilities and damages (whether direct, indirect, special, consequential, exemplary or punitive or other) arising from any participation by You at CASINO TIME.ca.

    Except as otherwise provided in the applicable Pay-to-Play Game Rules, CASINO TIME's (including, but not limited to the extent applicable, , CASINO TIME’s service providers, subcontractors, employees, agents, and assigns) maximum liability, subject always to Section 20.2 to You under this Agreement or otherwise in respect of the accessing or use of CASINOTIME.ca shall not exceed the lowest of:

    1. the dollar amount value of the wagers, purchases or tips actually made by a Player via their Player Account in respect of the relevant wager, purchase, tip or Game that gave rise to the relevant alleged liability; or
    2. the amount of applicable monies, where such monies have been improperly directed by CASINO TIME or misplaced by CASINO TIME; or
    3. an aggregate of $500 in respect of all other liabilities, including for liabilities resulting from or as a result of any negligent act or omission of or by CASINO TIME or any of CASINO TIME's service providers, or anyone acting on behalf of CASINO TIME or any of CASINO TIME's service providers.
    25.1 Exclusions From Casino Time's Liability

    Notwithstanding anything to the contrary contained in this Agreement, CASINO TIME shall not be liable for any loss or damage suffered by any person as a result of:

    1. the operation of CASINOTIME.ca, the iGaming Platform;
    2. the failure of CASINOTIME.ca, the iGaming Platform to operate properly or at all;
    3. the participation by any person in, or any failure, negligence or wrongdoing by CASINO TIME or any of CASINO TIME’s service providers in respect of, any responsible gambling program operated by CASINO TIME or any of CASINO TIME’s service providers, including: (i) the self-exclusion program; (ii) player breaks; (iii) deposit limits; (iv) spend limits; (v) playing time reminders; (vi) self-assessment tools; (vii) risk profiles;
    4. the failure of CASINO TIME or any of CASINO TIME’s service providers to: (i) process or record a purchase; (ii) display an accurate purchase confirmation in such person’s player account; or (iii) otherwise complete a transaction (including, without limitation, a Future Game Transaction);
    5. or any wager or tip erroneously or unintentionally made by a Player.

    25.2 For greater certainty, You shall not have the right to claim damages under or in connection with CASINOTIME.ca or this Agreement or for breach of this Agreement by CASINO TIME, in tort, in contract or on any basis whatsoever to the extent that any loss claimed by You is:

    1. for punitive, exemplary or aggravated damages; or
    2. for loss of profits, loss of chance, loss of use, loss of production, loss of business or loss of business opportunity, including (but not limited to) loss of data, profits, revenue, goodwill, reputation or business interruption; or
    3. a claim for consequential loss or for indirect loss of any nature suffered or allegedly suffered by You; or
    4. not reasonably foreseeable by CASINO TIME arising out of this Agreement or the use of CASINOTIME.ca.

    CASINO TIME does not make any other promise, representation or warranty regarding CASINOTIME.ca or any of the Games or other products or services that are made available on or through CASINOTIME.ca, and except as specifically included in this Agreement, CASINO TIME hereby disclaims all warranties regarding the foregoing, whether express, implied or statutory, including all implied warranties in respect of the same.

    You acknowledge and agree that, by accepting the terms and conditions of this Agreement, they do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding of any person, other than those of CASINO TIME which are included in (or expressly incorporated by reference into) this Agreement.

    26. ADVERTISING

    26.1 Publishing Winner Information

    If You win a sum of money or any other prize regarded by CASINO TIME as being worthy of publicity, You agree to make Yourself available for any event to publicize Your win arranged by the CASINO TIME.ca. CASINO TIME .ca will make reasonable efforts to protect Your privacy as part of such events. Further, You grant CASINO TIME the right to use Your first name in any publicity about Your win, along with the prize amount and town/city (as mentioned in this paragraph) and to use a picture of a model of CASINO TIME’s choice to represent You in any published materials.

    2. by e-mail, customersupport@CASINOTIME.ca. CASINO TIME will endeavor to respond to e-mails within 72 hours. If the e-mail address from which CASINO TIME receives a message does not correspond to the e-mail address that is included in the Player Contact Information that is associated with your Player Account, CASINO TIME will not provide any information relating to your Player Account when responding to your e-mail. In such circumstances, you may be requested or required to contact CASINO TIME by using Live Chat.
    27.2 CONTACTING A PLAYER
